USFK Blotter Report for May 2007

USFK has posted the blotter report for the month of May.  It was a busy month for the USFK legal system.  You can read the whole report below the fold:

Court-Martial Results for May 2007

At a general court-martial on 1 May 2007, Private First Class David M. Simmons, F Co, 302d BSB, 1st HBCT, 2ID, was convicted of two specifications of absence without leave, disobeying an order from a commissioned officer, and drunk and disorderly conduct. His adjudged sentence was reduction to E-1, confinement for four months, and a bad conduct discharge.

At a general court-martial on 1 May 2007, Sergeant Daniel B. Neikirk, C Btry, 1/38th FA, 210th Fires Bde, 2ID, was convicted of absence without leave. His adjudged sentence was reduction to E-1, confinement for ten months, and a bad conduct discharge.

At a general court-martial on 2 May 2007, Specialist James A. Smith, A Co, 1st BSTB, 1st HBCT, 2ID, was convicted of receiving child pornography and possessing child pornography. His adjudged sentence was reduction to E-1, forfeiture of all pay and allowances, confinement for seven months, and a bad conduct discharge.

At a general court-martial on 8 May 2007, Captain David M. Morey, 51st Operations Grp, Osan AB, was found not guilty of rape. The alleged victim was an Air Force officer.

At a general court-martial on 8 May 2007, Staff Sergeant Tyrone B. Edelen, HHC, Eighth US Army, was convicted of violating a general regulation by having an improper relationship with a lower enlisted Soldier, disobeying an order from a commissioned officer, and dereliction of duty. His adjudged sentence was reduction to E-5, forfeiture of $1,000 pay per month for two months, and hard labor without confinement for thirty days.

At a general court-martial on 9 May 2007, Private First Class Kevin D. Sowers, B Btry, 1/15th FA, 210th Fires Bde, 2ID, was convicted of five specifications of disobeying an order from a commissioned officer, twenty specifications of larceny, and six specifications of making and uttering worthless checks by dishonorably failing to maintain sufficient funds. His adjudged sentence was reduction to E-1, forfeiture of all pay and allowances, confinement for eighteen months, and a bad conduct discharge.

At a general court-martial on 9 May 2007, Private First Class Richard Butler, B Co, 302d BSB, 1st HBCT, 2ID, was convicted of violating a general order by violating the hours of curfew, using provoking speech, four specifications of assault, drunk and disorderly conduct, and disorderly conduct. His adjudged sentence was reduction to E-1, forfeiture of $500 pay per month for four months, and a bad conduct discharge.

At a general court-martial on 11 May 2007, Sergeant First Class Carlos L. Reynolds, HHC, 302d BSB, 1st HBCT, 2ID, was convicted of false official statement, two specifications of indecent assault involving two lower enlisted Soldiers, and obstruction of justice. His adjudged sentence was confinement for thirty months and a bad conduct discharge.

At a general court-martial on 15 May 2007, Private First Class William D. Gutierrez, HHC, 501st Sust Bde, 19ESC, was convicted of assault with intent to produce death or grievous bodily harm and assault consummated by battery. His adjudged sentence was reduction to E-1, forfeiture of $650 pay per month for twelve months, confinement for twelve months, and hard labor without confinement for three months.

At a general court-martial on 16 May 2007, Specialist Wesley S. Edmond, HHC, 2/9th IN, 1st HBCT, 2ID, was convicted of possessing child pornography and communicating indecent language to a person under the age of sixteen. His adjudged sentence was reduction to E-1, forfeiture of all pay and allowances, confinement for three years, and a bad conduct discharge.

At a general court-martial on 18 May 2007, Private First Class Jose A. Claudio, 4th Chem Co, 1st BSTB, 1st HBCT, 2ID, was convicted of two specifications of rape involving two Soldiers and forcible sodomy. His adjudged sentence was reduction to E-1, forfeiture of all pay and allowances, confinement for eleven years, and a dishonorable discharge.

At a general court-martial on 21 May 2007, Corporal Carl J. McCourt, 19th AG Co (Postal), US Army Troop Command – Korea, was convicted of two specifications of false official statement, stealing mail, and obstruction of justice. His adjudged sentence was reduction to E-1, forfeiture of $800 pay per month for seven months, and confinement for seven months.

Results of ROK Criminal Prosecutions for May 2007

In Seoul Central District Court on 3 May 2007, Sergeant Daniel B. Neikirk, 1/38th FA, was convicted of fraud. His adjudged sentence was a 2 million Won fine.

In Seoul Central District Court on 4 May 2007, Private Justin R. Brown, 595th Maintenance Company, was convicted of aggravated assault. His adjudged sentence was confinement for 8 months, suspended for 2 years.

In Seoul Central District Court on 4 May 2007, Private Anthony W. Faulkner, 595th Maintenance Company, was convicted of aggravated assault. His adjudged sentence was a 2 million Won fine.

In Seoul Central District Court on 7 May 2007, Sergeant First Class Walter H. Flinn, HHC, 8th US Army, was convicted of DUI. His adjudged sentence was a 2 million Won fine.

    The lucky one's did their deeds off duty, it seems. Two million won is better than a bad conduct discharge, or maybe that follows.

    Does anyone know what "hard labor" consists of?

    I know one of my uncles was constantly in trouble during WWII, sneaking off to womanize and get drunk. He dug a lot of holes and filled them up, carried a lot of rocks from A->B->A, and was still a buck PVT at the end of the war.

    I had a guy on hard labor for 30 days and for those 30 days he worked directly for the battalion CSM. He filled a lot of sand bags around the camp because the monsoon season was coming, pulled weeds, painted buildings, among a host of other stuff from 0900-2100 hours every day. Plus he did it while wearing his full gear. It was not a pleasant experience for him.

    Well one thing I notice about all this is the Enlisted is Always found guilty…especially the lower ones yet it seems the officer is somehow found innocent…of one of the more serious charges

    Its like the LT who refused to leave with his unit to go to Iraq but his trial was a mistrial because the Judge found the LT did not understand the document he was signing?

    A young private not understanding stuff they sign…likely…but an officer…not likely

    WTF? The AWOL got a higher sentence than a child porn case? Are you effing kidding me?

    And why are these cheese-sandwich AWOL cases going to trial? I see a docket with company grade and field grade Article 15 stuff. Are these guys turning down Article 15's? It's called "client control!"
