November’s court martial results are just another month with typical stuff you see every month on the blotter: credit card fraud, minor assault, an attempted rape, along with the last of the percocet gang being sentenced. Something interesting in the Korean court results I found interesting was that Private Dustin Roper of Beauty Shop Bandit fame and of a scuffle in downtown Dongducheon received a 4,000,000 won punishment for the altercation.
I take this relatively light punishment as meaning that Roper probably didn’t start the fight considering how the prosecution was seeking a jail term for him. His battle buddy PFC Roy Anderson who appeared to be a victim of assault may have had no charges brought against him considering there was no court results for him, unless the Korean courts are waiting to try him in December.
Another thing I noticed from the Korean court results is that yet another DUI happened last month. That makes eleven DUI convictions in eight months. That is not good and it is something you cannot blame on young enlisted soldiers because the vast majority of the DUIs are from senior leaders with November’s DUI coming from a Chief Warrant Officer 2. The DUIs are a ticking time bomb and if God forbid one of them ends in a fatal accident you can expect the Korean media will look at these DUI stats from this year and compare them to what USFK did to prevent them.

USFK Court-Martial Results for November 2007
At a special court-martial on 1 November 2007, Airman First Class Jonathan W. La Rosee, 51st Security Forces Squadron, was convicted of wrongful use and distribution of a controlled substance (Percocet). His adjudged sentence was reduction to E-1, three months confinement, and forfeiture of $400 per month for three months.
At a general court-martial on 13 November 2007, Specialist Trenton R. Chatman, HHC, 1st BSTB, was convicted of attempted rape and attempted forcible sodomy. His adjudged sentence was reduction to E-1, 18 months confinement, and a bad-conduct discharge.
At a general court-martial on 13 November 2007, Private Charles B. Presnell, B Battery, 6/37 Field Artillery, was convicted of conspiracy to commit larceny, larceny, and AWOL. His adjudged sentence was 14 months confinement and a bad-conduct discharge.
At a special court-martial on 15 November 2007, Airman First Class Jeremy A. Kyner, 51st Security Forces Squadron, was found not guilty of wrongful distribution of a controlled substance (Percocet).
At a general court-martial on 15-16 November 2007, Staff Sergeant Andre D. Gundy, HHC, Eighth U.S. Army, was convicted of conspiracy to commit larceny, dereliction of duty, and false official statement. His adjudged sentence was a reprimand, reduction to E-3, forfeiture of $500 per month for 24 months, 60 days restriction, and 90 days hard labor without confinement.
At a special court-martial on 19 November 2007, Private Daniel K. Schneider, A Company, 2/9th Infantry, was convicted of larceny, stealing mail, and AWOL. His adjudged sentence was five months confinement and a bad-conduct discharge.
At a special court-martial on 20 November 2007, Private (E-2) Rolando A. Maitland, 520th Maintenance Company, 194th CSSB, was convicted of assault consummated by a battery. His adjudged sentence was 45 days hard labor without confinement.
At a special court-martial on 21 November 2007, Private First Class Marvin R. Calhoun, Jr., 520th Maintenance Company, 194th CSSB, was found not guilty of conspiracy to obstruct justice and of obstruction of justice.
ROK Criminal Prosecution Results for November 2007
In Suwon District Court on 6 November 2007, Private Gregory L. Benson, 1st Signal Bde, was convicted of larceny and credit card fraud. His adjudged sentence was a 3,000,000 Won fine.
In Suwon District Court on 7 November 2007, Chief Warrant Officer 2 Desmond E. Ray, 3-2d Aviation, was convicted of DUI. His adjudged sentence was a 700,000 Won fine.
In Uijongbu District Court on 21 November 2007, Private Dustin T. Roper, 2/9th Infantry, was convicted of aggravated assault. His adjudged sentence was a 4,000,000 Won fine.
In Uijongbu District Court on 26 November 2007, Sergeant Arin S. Wilson, EUSA NCO Academy, was convicted of infliction of bodily injury. His adjudged sentence was a 1,500,000 Won fine.
