Last month’s USFK court martial results had a few incidents of note. The two that jumped right out at me at first were the two marijuana convictions. In each case the soldiers were both convicted of distributing and using marijuana and one of them was actually using cocaine as well. However, one soldier gets a bad conduct discharge while the other who just happen to be the cocaine user as well gets to stay in the Army.
I had a prior battalion commander who had no tolerance for drug abusers and would always recommend they be discharged from the Army while I have had other commanders that were big into rehab for the soldiers and letting them stay in. I’m of the school of thought that if you get caught using drugs in the military you should be gone no matter how great of a soldier you are. I just have no tolerance for drug abusers and I think soldiers using drugs are just a sign of more problems down the road that will come from them.
In the ROK criminal court there was three arrests which included yet another DUI with this one even being a hit and run. Surprisingly I didn’t see this make the national papers. If it had anything to do with him being a Korean-American sailor is anyone’s guess. Maybe the Navy has different rules but it would seem a petty officer shouldn’t be driving a civilian vehicle in Korea. Anyway this now makes 12 DUI convictions in the last 10 months. Folks that is not good and an incident just waiting to happen.
Another Korean court conviction of interest is that PFC Dustin was convicted of destruction of private property and trespassing. ROK Drop readers may remember Roper as the Beauty Shop Bandit who also received a beat down in the Dongducheon 2nd Market area as well as being the reason behind a one man protest in front of the Blue house and a Hanchongnyun protest outside Camp Casey. Considering all the noise surrounding him, he left Korean court without serving any jail time.

USFK Court-Martial Results for January 2008
At a general court-martial on 12 January 2008, Senior Airman Gabriel R. Contreras, 51st
Munitions Squadron, was convicted of conspiracy to commit an indecent act, rape,
housebreaking, and an indecent act. His adjudged sentence was reduction to E-1,
forfeiture of all pay and allowances, confinement for one year, and a dishonorable
discharge.
At a special court-martial on 14 January 2008, Private First Class Jerriett J. Hand, 19th
Adjutant General Company, U.S. Army Troop Command-Korea, was convicted of
conspiracy to commit larceny, larceny, and wrongfully opening mail. His adjudged
sentence was reduction to E-1, five months confinement, and a bad conduct discharge.
At a general court-martial on 15 January 2008, Specialist Milton Bermudez II,
Headquarters and Headquarters Support Company, Division Special Troops Battalion,
2nd Infantry Division, was convicted of aggravated assault. His adjudged sentence was
reduction to E-1 and four months confinement.
At a special court-martial on 16 and 17 January 2008, Specialist Cristobal E. Paulos,
19th Adjutant General Company, U.S. Army Troop Command-Korea, was convicted of
conspiracy to commit larceny, wrongful distribution of marijuana, wrongful use of
marijuana, and wrongful use of cocaine. His adjudged sentence was reduction to E-1,
forfeiture of $893.00 pay per month for three months, 60 days restriction, and 90 days
hard labor without confinement.
At a general court-martial on 18 January 2008, Sergeant Michael D. Daniels,
Headquarters and Headquarters Company, 1st Brigade Support Troop Battalion, 1st
Heavy Brigade Combat Team, 2nd Infantry Division, was acquitted of rape.
At a general court-martial on 21 January 2008, Sergeant Christopher L. Fairley, E
Company, 4-2 Aviation Regiment, 2nd Combat Aviation Brigade, 2nd Infantry Division,
was convicted of adultery. His adjudged sentence was reduction to E-1, 60 days hard
labor, and an oral reprimand.
At a general court-martial on 22 January 2008, Private First Class Elisa E. Gonzalez,
150th Minimal Care Detachment, 121st Combat Support Hospital, was convicted of
attempted wrongful distribution of marijuana, wrongful distribution of marijuana, wrongful use of marijuana, and wrongful possession of marijuana. His adjudged sentence was reduction to E-1, forfeiture of all pay and allowances, confinement for 13 months, and a bad conduct discharge.
At a general court-martial on 23 and 24 January 2008, a Captain, Eighth United States
Army, was convicted of assault consummated by a battery upon a child under the age
of 16. His adjudged sentence was 100 days confinement and a reprimand. His name is
being withheld to protect the victim’s identity.
At a general court-martial on 24 January 2008, Sergeant Rodrigo Valdiviagonzalez,
Headquarters and Headquarters Detachment, 36th Signal Battalion, 19th Sustainment
Command (Expeditionary), was convicted of adultery. His adjudged sentence was
reduction to E-3, 60 days restriction, and 60 days hard labor without confinement.
ROK Criminal Prosecution Results for January 2008
In Suwon District Court on 11 January 2008, Petty Officer 2 Ki Dong Lee, HQ, US Naval
Forces, Korea, was convicted of DUI and a vehicular hit and run. His adjudged
sentence was imprisonment for 8 months, suspended for 2 years.
In Uijongbu District Court on 16 January 2008, Private Dustin T. Roper, HHC, 2/9th
Infantry, was convicted of destruction of private property and trespassing. His adjudged
sentence was imprisonment for 8 months, suspended for 2 years.
In Daejon District Court on 18 January 2008, Private Ivy N. Westbrook, 249th MP
Detachment, was convicted of obstruction of justice and infliction of bodily injury. His
adjudged sentence was a 2,000,000 Won fine.
