Really nothing of significant interest this month’s USFK court martial results othen then yet another Driving Under the Influence arrest. For those keeping track, that is the 14th DUI in the last 12 months. This is something that can’t be blamed on junior soldiers because it was another chief warrant officer that was arrested. This is a trend that could come back and haunt USFK if one of these servicemembers driving drunk causes a fatal accident.

USFK Court-Martial Results for March 2008
At a general court-martial on 11 March 2008, Specialist Sean C. Welch, 5th Medical Detachment/168th Medical Battalion, was convicted of conspiracy to commit an indecent act, indecent act, and false official statement. His adjudged sentence was reduction to private (E-1), 60 days restriction, and 90 days hard labor.

At a general court-martial on 13 March 2008, Private First Class Michael K. McPhatter, 121 Combat Support Hospital, was convicted of committing an indecent act. His adjudged sentence was reduction to private (E-1), forfeiture of $500 pay per month for three months, 30 days restriction, and three months hard labor.

At a general court-martial on 17 March 2008, Specialist Dennis R. Cummings, 3rd Battlefield Coordination Detachment, was convicted of wrongful possession of Tylenol 3 and adultery. His adjudged sentence was reduction to private (E-2), 30 days confinement, and a reprimand.

ROK Criminal Prosecution Results for March 2008
In Suwon District Court on 10 March 2008, Sergeant First Class Raymond D. Buch, 3d Military Intelligence Battalion, was convicted of a vehicular hit and run. His adjudged sentence was a 700,000 Won fine.

In Suwon District Court on 11 March 2008, Senior Airman Byoung O. Kang, 51st MOS, was convicted of infliction of bodily injury. His adjudged sentence was a 2,000,000 Won fine.

In Seoul Central District Court on 19 March 2008, Private Matthew L. Gardner, HHC, 2/9th Infantry Battalion, was convicted of robbery resulting in injury. His adjudged sentence was imprisonment for two years and six months, suspended for four years.

In Suwon District Court on 26 March 2008, Chief Warrant Officer 2 Jeremy S. Eberly, C Company, 4/2d Aviation Battalion, was convicted of driving under the influence of alcohol. His adjudged sentence was a 1,000,000 Won fine.
