It seems like acquittals for rape and sexual assault in USFK are becoming more and more frequent now a days:
A Camp Humphreys soldier was found not guilty Friday of sexually assaulting a soldier while she lay asleep in the barracks.
Spc. Jason Kelling of Headquarters and Service Company, 3rd Military Intelligence Battalion, had been charged with aggravated sexual assault in a court-martial before military judge Col. Donna M. Wright and a seven-member jury.
The woman testified that Kelling had raped her sometime during the night of Nov. 21 or early Nov. 22. Kelling, the woman and a third soldier had been eating, drinking and playing pool off post.
According to the woman’s testimony, all three had consumed alcohol, then drank wine back in Kelling’s room.
Eventually, she testified, the three lay on Kelling’s bed and fell asleep.
The woman testified she awoke to find Kelling having sexual intercourse with her. [Stars & Stripes]
Here is a memo to the ladies out there, don’t go drinking with some guy, then make sexually provocative gestures to him, then willingly go back to his room, lie in bed with him, and wonder why he had sex with you. It may be hard to believe but things like that tend to tip off a young male soldier that you want to have sex with him.
However, this guy was lucky he did not get convicted because he did have the girl go back to his barracks room which usually tends to lead to a conviction. He was lucky he had a witness defend him that saw her making sexually provocative gestures towards him that night. I cannot stress this enough, go to the hotel and not the barracks room because a hotel shows a level of consent from the woman for agreeing to go to the hotel. Pay the few extra bucks for the room because it will be worth it by not being accused of rape later.
