The infamous activist judges in the 9th US Circuit Court of Appeals have struck again:
The military cannot automatically discharge people because they’re gay, a federal appeals court ruled Wednesday in the case of a decorated flight nurse who sued the Air Force over her dismissal.
The three judges from the 9th U.S. Circuit Court of Appeals did not strike down the military’s “don’t ask, don’t tell” policy. But they reinstated Maj. Margaret Witt’s lawsuit, saying the Air Force must prove that her dismissal furthered the military’s goals of troop readiness and unit cohesion.
The “don’t ask, don’t tell, don’t pursue, don’t harass” policy prohibits the military from asking about the sexual orientation of service members but requires discharge of those who acknowledge being gay or engaging in homosexual activity. [Associated Press]
First of all let me state that this case is very strange. The article claims Major Witt was kicked out of the Air Force for being gay after her command was tipped off to her sexual orientation. You cannot kick somebody out of the military because of a tip. I suspect there is more to this story, but I doubt it will ever be reported because the activist media already have their narrative.
Maybe you all in the Air Force can explain the culture in the Air Force in regards to homosexuality, but in the Army unless you are flaming gay, people will leave you alone. I have known of people in my prior units that were gay but as long as they weren’t marching in gay pride parades and hitting on other soldiers no one cared. I have never been in unit that had some one chaptered for being gay and only personally know one person who had to chapter someone for being gay. I did have a soldier who wanted to be chaptered for being gay even though he wasn’t because he wanted to get out of the military. There is no witch hunt going on and gays have even admitted it.
Something that has always annoyed me about this issue is that the activists always go after the military when this policy is legislated by Congress, not the military. Who currently controls Congress? Yes, the gay friendly Democratic Party. Why aren’t the activists breaking down the door of Nancy Pelosi and Harry Reid’s offices? Even more ironic is that Democratic President Bill Clinton made the policy to begin with. This is an issue that is a legislative issue and I am uncomfortable with activist California judges getting involved in it.
