Predictions for Future Protests (Part II)

PART II of the posting deals with suggestions for the tactical deployment of riot policemen using the suggestions we made in Part I. This is nothing more than brain-storming. We are certain that there are a lot of holes in our ideas. Our prediction that large scale demonstrations (1000-2000 people) are coming true NOW. They will either (1) Attack static defense lines (bus barricades); or (2) Attack police lines set up to stop the movement of the protestors. Each has their own defenses. Our suggestions are on the tactics are based on what we have observed the riot police actually do during the past riots. There were successes — which no one seemed to notice — and failures — which everyone jumped on.

The first tactic is based on what we call “The Modified Ghengis Khan Circle-of-Death” which traps everyone in an ever tightening circle. This was used on 29 Jun — but the only problem is that it trapped many of the people the police did NOT want to trap — ie, Kang Gi-Kap and other politicos, religious leaders, etc. — and In the end, they let everyone go. For this reason, we are NOT supporters of this tactic.

The second tactic is what we call the “Divide-and-Conquer” which was executed with perfection on 25 Jun. This tactic separates the violent elements from its peaceful support element (”innocent” bystanders with their children, politicos, religious leaders, elderly, and the simply curious). What we recommend is a modification of their maneuver which closes off escape — and allows the support element to escape the advancing rear echelons while forward units contain the violent elements until the rear echelon arrives to support them. We also recommend new tactics for the water cannons which contain dye and SMALL amounts of liquid tear gas (just enough to stink up their clothes). We recommend the water cannons use being changed from an offensive high-pressure weapon into a low-pressure fan-spray marking device.

The bottomline in our suggestions is that these protestors using hit-and-run tactics are actually using the same techniques we mention here — but in small group actions. They will isolate police and then commit violence upon them including beatings, theft of property. They will isolate ANYONE who they THINK is supporting an opposing view and commit violence upon them including beatings, theft of property. They are operating on mob psychology where the violence is somehow excused by the actions of the group. The police need to protect their forces by tightening their lines — drawing all units back into their forces. The types of violence seen in mid-Jun of isolating and then brutally attacking individual policemen are on the increase.

This part deals primarily with handling large scale demonstrations. Since the venue that the activists have consistently selected is in the Chongno, Seoul Plaza and Cheongye Stream areas, the police can at least plan for their attacks.

The reason we are not mentioning Small-group guerilla hit-and-run (10-15 people) in Part II is that they will be virtually impossible to stop. These became popular in the mid-1990s when college students stopped joining the groups because they were too busy trying to get a job. These hit-and-run demonstrations are quick and are mainly aimed at disrupting traffic — sometimes by violent means — and disappearing before the police arrive. Though the operations will change to take advantage of advances in technology, they are still the same ruthless operations by hard-core activists — but now will include gullible youngsters.

We are also recommending actions to go after the pocketbooks of the protestors. In conjunction with this, we make suggestions that a “temporary court” be set up on site along with a on-site booking center and on-site holding area. In other words, we propose a one-stop holding, booking and trial process.

PART II: PREDICTION: VIOLENT PROTESTS DROP TO 1,000-2,000 PEOPLE LARGE-SCALE PROTESTS :

Violent confrontations with police lend themselves to large scale protests over 5,000. However, we believe that in the future there will be fewer of these large scale protests. We believe the people of Korea are simply burnt out on protests. Though many may support the causes, they will be unwilling to join in them — unless the protests turn into “festivals” as they were during the waning days of the anti-US beef protests. The large scale protests of 5,000-10,000 will recede, but there still will be violent protests in the 1,000-2,000 range made up of the hard-core activists and the Hanchongryeon.

Perhaps one of the last large-scale violent protests will be the protest planned on 6 Aug 2008 when President Bush arrives enroute to the Chinese Olympic Games. The Hanchongryeon were out “practicing” some of their new techniques to block traffic on 26-27 Jul in preparation for the event on 6 Aug with an estimated 1,500 people. Though the protests were large, they in no way were anywhere near the 10,000 levels normally associated with the past anti-US beef protests. Only the hard-core radical elements — the ones who have been violent all along — were in attendance.

Undeniably, part of the 26-27 Jul protest was to taunt and bait the police into a violent acts so that the KBS/Hankyoreh crews standing by could provide photographic “evidence” of police brutality to the Human Rights “inspection teams” in town. The inspection teams had stated their report would be out on 25 Jul but had delayed their report.

However, the crowds of “innocent” bystanders (protestor support element) which have been used as a “shield” for the radicals to run and hide in after violence has been steadily dwindling — and in the last protest, absent. These people were the ones that hung far to the rear — observing the violent protests. It could be the weather or it could be because the interest is dwindling in protests in general. For whatever reason, we feel there is going to be a change in tactics on the part of the radicals. With the protestors becoming mobile, the crowds as observers — acting as a support element for the protests — will disappear as they MUST choose between becoming part of the mobile protest — or staying home. We think they will stay home.

The protest scheduled for 6 Aug on the arrival of President Bush on his way to the Olympics will be the last gasp attempt to try to mobilize the people in protest against the US beef agreement. The arrival to the first shipment of LA Kalbi and the wide acceptance of the inexpensive beef may take the wind out of its sails as well.

We believe that it will be a large and violent protest, but that it will be made up of the hard-core activists and Hanchongryeon. Besides the Hanchongryeon, one can expect the unions of YTN unhappy over the selection of the President for YTN; the KCTU whose leaders are under indictment for the protests; the KTEWU under attack for its teaching of misinformation; and the Hanchongryeon now under attack with the NIS looking into its leadership for NSL violations. Most likely the activist religious orders will also attend — especially the Jogye Buddhist order that is harboring 6 leaders of the anti-US beef protests who are under indictment. Also to be expected with be the members of the internet Agora groups who have been very active in spreading misinformation about the US beef in the past. KBS and MBC will be there to provide selected press coverage — meaning that they will photograph when the police react, but stop filming when the protestors beat on the police as they have since Roh Moo-hyun came to power.

These groups are the hard-core radical activists who have been directly involved in the violence of the past anti-US beef protests. Because there will be a smaller showing of “shields” (innocent bystanders) who stand out of range of the water cannons during violence and then act as a hiding place after the police react, there may be a change in tactics. The religious orders will probably take up the peace chants early in the day and then leave the battleground to the hard-core KCTU and Hancheongryeon in the evening. If the pattern follows, they will strike the police lines at approximately 12 midnight. (NOTE: We believe this time was chosen as the family groups usually depart the area between 10-11 pm in the evening.)

However, the reduction in the masses of protestors we believe will result in a change in tactics. We believe that because they will not be able to muster the tens of thousands that they had in the past, they will use some of the hit-and-run guerilla tactics of hitting the police at multiple locations with small groups and then fall back or run away. This was seen in the 20 Jul protests.

We also believe that the long-term protests (small numbers but permanent protests in nature) will be down near the Namdaemun traffic circle to disrupt traffic rather than any head-on charges against the police barricades. The intent will be to disrupt the late night traffic — and provide as much photo-op coverage as possible for the national and international news services. (NOTE: This will be discussed later on how the activists use minimal manpower (2-15 people) — or none at all — to achieve maximum results (tying up police units and maximum publicity coverage) with minimal risk.)

A. SUGGESTIONS FOR CONTROLLING LARGE SCALE PROTESTS (1,000-2,000 PEOPLE): The biggest decision that has to be made prior to moving on the protestors is whether to arrest the support elements (on-lookers) or to let them go. If they are to be allowed to escape, the riot police will create avenues for them to flee the area. If all the protestors are to be rounded up, the riot police will have to seal the entire street and move forward until like on the 29 Jun protests, they are all corraled and order to sit down.

There will be two methods:

  • a. If the decision is to arrest ALL the protestors (both violent protestor and non-violent support element), the wings will swing out from the rear echelon and tighten the trap on the entire group. This is the method used in the 29 Jun protest. When the riot police approach the group, wings will fan out from both sides and retake the sidewalks. At that point, the masses will be “squeezed” and like the June 29th quashing of the violence, the protestors will be ordered to sit down and await disposition instructions. In this maneuver, the bulk of the riot police will be in the rear echelon. The elements that are retaking the sidewalks function are basically there to distract the violent protestors until the rear echelon moves up. Once the support elements panic, they will crowd in on the violent protestors limiting their action. This is what we call the “Modified Ghengis Khan Circle-of-Death.” Remember that the support element usually contains religious leaders, politicians, mothers with children, and all the others the police do NOT want to arrest. This method is NOT recommended.
  • b. If the decision is to allow the protestor support element to escape, but trap the violent protestors, some way must be done to separate both units. In this method, riot police will charge from the sidewalk openings along the bus barricade and occupy the sidewalks awaiting the rear echelon to move up. In this maneuver, the forward elements retaking the sidewalks will have the bulk of the riot policemen. The riot police in control of the sidewalks can either (a) remain in place until the rear echelon comes forward to join with them; or (b) close the trap and allow the support elements to escape to the rear — as the rear echelon moves up to protect its rear. Closing the trap is the preferred method. Probably the decision to close the trap immediately will be made as soon as the rear echelon starts its movement forward. The idea would be to prevent the escape of the violent protestors who have already been marked by dye and tear-gas smell. The riot police usually outman the violent protestors 3:1 so it is possible to restrain their retreat. The key to success of this movement is to NOT move the control of the sidewalk line past the point of the protestor support elements (on-lookers) in the rear. At that point, the support element who are not fighters will have fled to the rear creating a space between them and the violent protestors. It is a simple matter to close the wings — even if they give up the sidewalks temporarily — awaiting the rear echelon to come to back them up. This is what we call the “Divide-and-Conquer Maneuver.”

Our suggestions for the riot police are:

  • 1. BLOCK THE EXIT TO THE REAR: The police need to adopt strategies to plan to block any protestors escape routes. We recommend the pre-positioning of riot police in the underground subway systems in large numbers. To the bystanders, the riot police will appear to be only there to block the entrance.If there is trouble, the police need to “explode” out of the subways and form a cordon to block escape. As soon as the police move to take control of the sidewalks, riot police that had been prepositioned in subways will close off the streets. These riot police can be moved into position through the Seoul Station subway underground while the violent protestors are focused on attacking the police barricade blocking their way to Cheong Wa Dae. The truck mounted water cannons — parked out of sight on side streets — should be moved up to back up the police line that blocks the exit. (NOTE: Again we caution the police as their radio communications have been compromised. The lost of police radios being stolen has increased in the past violent protests indicating the protestors will be monitoring police movements. Other forms of communication — even cell phones — might be considered.)Police plans should also include the blocking side streets in case the protestors attempt to break out using them. As a choke point, these side streets are not a good escape route for the protestors and easily blocked off.
  • 2. USE MODIFIED “GHENGIS KHAN CIRCLE-OF-DEATH” MANEUVER: This is the maneuver that is used if ALL the protestors are to be arrested as in the 29 Jun protest. The following is basically what happened on 29 Jun except for our recommendation to not rush forward, but rather to advance very methodically — using psychology to increase terror and panic. The bus barricade prevents escape forward and the rear echelon riot police backed by water cannons will move forward. The water cannons will fire only at the command of the site commander as a last resort.Once the riot police start to tighten the circle, the protestors will normally attempt to escape. Some of the hard-core activists and violent protestors (having gone through this drill before) will rush to the rear to try to breach the line and create a hole for escape. It is imperative that the line holds.If the protestors start to fall back in panic, the battle is won. The police need to swiftly move forward to consolidate their gains — but do not rush forward as was a mistake in the 29 Jun protests. It is imperative that they do NOT use excessive force against fleeing protestors. The rule should be that if a person attacks the line, put him down with all force necessary. If the person is moving away, do NOT chase — but keep the line moving steadily forward to tighten the trap.As the rear echelon starts to squeeze the protestors, the riot police should fan out as they did on 29 Jun to retake the sidewalks. At that point, the masses will be trapped as they were on 29 Jun. At that point, the protestors will be ordered to sit down and await instructions as to what to do next.However, it has to be remembered that the people in the protest support elements may contain politicians, religious leaders and other influential people. This creates a “political problem” dealing with the arrests and how to screen them out as it did on 29 Jun. In the end, everyone had to be released — causing the riot police to lose whatever “face” it had regained in capturing the protestors enmasse. For this reason, we do NOT recommend this tactic’s use.HOWEVER, this movement can be effective for violent protestors on a TRAFFIC CIRCLE. The maneuver can be modified for use on a situation where the protestors occupy a traffic circle and play cat-and-mouse to evade capture and disregard direct order to disperse. The tactic would be to have a coordinated move to block off all streets leading to the traffic circle at the same time. (NOTE: We caution the police that the protestors HAVE compromised their radio net. All movements can NOT be broadcast using current radios which have not had their frequency crystals replaced.)

    Once the traffic lanes to the traffic circle have been sealed off — close the circle by deploying the riot police in the wings outward until they join. Then close the circle. AGAIN the rule is that the force used will only be equivalent to the force given. In other words, if a person shoves on a police shield, shove back. Police are encouraged not to overreact and use batons unless the protestors have already proven to be violent during the course of the specific protest.

  • 3. USE “DIVIDE-AND-CONQUER” MANEUVER: This is the maneuver used if only the violent protestors are to be arrested. We watched this maneuver effectively used by the riot police during the latest anti-US beef protests to separate the violent protestors at the front from its support element (on-lookers) in the rear. After that the protest was over. Though no one caught it, I watched it on the internet live during the 25 Jun protests and it was fascinating as to how well it was executed. The police divided the violent protestors from the support unit to rear. They immediately started to close the circle around the protestors. As they moved forward, a line of riot police rushed in to prevent the support unit from turning violent and attacking the rear of the advancing policemen. The support unit did not and the protest was over in about five minutes. As soon as the banners started disappearing in the live broadcast, we knew the protest was over for the day. It was perfectly executed. I am certain that this is one of the maneuvers that the riot police are commonly drilled in, though I had never seen it used so effectively before.If you watch the videos of all the past protests in the anti-US beef protests, the support element (on-lookers, fanatics who bring their babies to these violent protests, religious leaders, politicians, and influential activist NGO leaders) are in the rear. They have no intention of entering the battle — only giving moral support by adding their numbers to the protest. In fact, many of these people are actually against the violence but are present because the believe in the anti-LMB or anti-US beef campaigns.

    To effect this maneuver, the same method of taking the sidewalk would take place, but once done, then the ends will close where there is a significant space that ALWAYS forms between the violent elements and the support elements. The support elements will naturally flee to the rear and will face the other riot police in the rear echelon — backed by water cannons — moving up.

    The wings from both sides of the streets of those who took the sidewalk will swing inward to prevent the escape of the violent protestors — who have already been marked by dye and tear gas smell. Sufficient numbers of riot police must be used to block the violent protests. In this operation, the bulk of the riot police will be used to secure the sidewalks, while the rear echelon would consist of the backup unit.

    In a matter of minutes, the protestor went from having one “front” forward — to two “fronts” on their flanks as the riot police rushed down the sidewalks — to “fronts” on all sides as they become surrounded. The advantage is to the riot police who usually outnumber violent protestors by 3:1. The rules of engagement remain the same. If a person shoves on a police shield, shove back. Police are encouraged not to overreact and use batons — unless the protestors have already proven to be violent during the course of the specific protest. If the presence of violent weapons have been used in the demonstration, the protestors are warned repeatedly over the loudspeaker to lay down their weapons. If police are attacked with the weapons, deadly force is permitted to arrest the violent criminal — but evidence must be retained of the weapon to later substantiate the charges against the protestor.

    The intent is to deliberately allow the support elements to ESCAPE around the sides (via the sidewalks) to bypass the approaching rear echelons of riot police and water cannons. Extreme care must be used again NOT to use force against the support elements. The rule again is if they attack the police line, equivalent force will be used against the violent protestor. Again the rear echelon must move up steadily in the CENTER of the street. Any violent protestors who escape using the support elements as their shield will be left to the Regular KNP in the rear to spot and arrest. These violent protestors are already marked with dye and tear-gas stink so it will be easy to pinpoint them.

    However, the main intent is to not break the line and keep it steadily moving forward. In other words, there will be no running charge — only the rhythmic beating of the shields similar to that used by the Zulu warriors (and practiced by the riot police) as an intimidation device. A big mistake for the riot police in all their attacks is that some always move forward too far and too fast — and end up getting severely beaten as they are swiftly surrounded by protestors. (NOTE: Hard-core activists will react with scorn to this tactic of beating on the shields as they did in some of the recent protests — hurling taunts and jeers at the police. However, for “rookie” protestors it can be a daunting experience.)

    The intent is to create panic in the non-violent support element who are not the fighters. In the 1970s, the riot police used the drag-and-stomp as well for intimidation. Basically that was to drag one foot forward bring it even with the next and stomp. Dragging the foot was so that you would not lose your balance if attacked by a protestor while moving forward — and the stomp was for intimidation. We would recommend that they bring it back into use.

  • 4. MOVE TO CONTROL THE SIDEWALKS: Forget about the frontal line the police always form to try to move the protestors back. Instead, move the riot police rapidly down the sides to take control of the sidewalks. We have watched the riot police use this maneuver with some success during the past anti-US beef protests. Once the sidewalks are controlled, then the police can move inwards to squeeze the protestors.With the old method of the police in front of the buses, there was only one “front” — but with the control of the sidewalks, the protestors now have to defend on two “fronts” that were their flanks. By splitting the protestors violence, the attacks become more manageable.Within minutes, the unconscious decision as a group will be made by the violent protestors whether to stay and fight or to flee. If the violent protestors decide to “fight-to-the-death” than those elements on the sidewalk must defend their ranks until the rear echelon comes up. If the protestor support elements start to flee, it can be contagious and the violent protestors may join in. Those in the support elements are those that chose not to be violent and they pose a negligible risk of joining the attack. As shown in past protests where the police decided to take control, the protestor support elements have fled to the rear.
  • 5. EMPLOYMENT OF WATER CANNON CHANGE: The water cannon must ALWAYS be a weapon of LAST resort. If a large scale protest should occur where the violence is out of hand, only then will the water cannon be used. However, we are suggesting that the water cannon no longer be used as a defensive weapon to ward off attacks from the violent protestors, but as a marking tool to identify the violent protestors who are committing violent crimes.Instead of a high-pressure stream of water, it should be changed to a low-pressure fan spray to distribute the dye and liquid teargas as widely as possible over the front ranks of the violent protestors. Because of the height of the cherry-picker arm, the spray should be able to spray an area covering six lanes of traffic — and reach about 80 feet to the rear.However, they should add SMALL amounts of liquid teargas to the water — just enough to stink up the violent protestors’ clothes (and irritate their eyes) — and dye to mark their clothes and persons.

    The “innocent” bystanders (protestor support element) in the rear of the crowd will not be touched, but those in the front committing violence will be easily identifiable and detected by smell if they are on the subway or other exit points.If the water cannon containing dye and small amounts of liquid tear gas is decided on, it will be easy to identify the dye-marked violent protestors from the “innocent” bystanders in the support element.

    The idea is that the water cannon marking the violent protestor will prevent them from escaping by mingling with the support elements to the rear. The support element is usually well out of range of the water cannons to the rear and are not participating in the violent acts. The use of the water cannon probably would NOT be a good method to be used in conjunction with the “Modified Ghengis Khan Circle-of-Death” and would in our estimation be very time-consuming to process all the arrested protestors — not mentioning the arrest of many politicians and influential activist leaders that turns everything into a political “hot potato.”

    It would probably be better to use the water cannons in conjunction with the “Divide-and-Conquer Maneuver.” In this maneuver, you only deal with the violent protestors — and those violent protestors that escape can be picked up as the dye and smell will make them stand out in a crowd. The use of the water cannon would be BEFORE the police moved in to capture the protestors.The key to its effective use is that the the avenues must be blocked off BEFORE the water cannon is used. Thus when the crowd disperses, it will be easy to arrest the violent protestors by the dye and smell on their person. In the past, the violent protestors have used the “innocent” bystanders (support element) — who are actually supporters of the protest, but not taking part — to hide amongst to disperse.

    We would suggest the use of the cherry picker water cannons exclusively in conjunction with bus barricades. They are effective in reaching over the bus barricades to spray down the front ranks of the offenders. In addition, we suggested earlier that the cherry picker boom should be fitted with telephoto cameras to capture the violent acts — as they happen — and broadcast them via the internet. These will be archived and later used as proof of the violence.

    The tanker truck mounted water cannons are NOT effective when used in conjunction with bus barricades. Recommend the use of the truck mounted water cannons as backup for the riot police when they seal off the streets in the rear of the protest. These trucks would be prepositioned on adjacent streets and when the protestors start their attack, their attention will be focused to the front. At this point the truck mounted water cannons can be moved up as the riot police move swiftly to block off the avenue of escape.

    These water cannons will also have the dye and tear gas mixture in them. If the protestors try to use force, then the water cannons can be used upon them at the riot police commander’s discretion. No second notice of warning is required. Tactics need to be worked out so that the water cannon is in the FRONT of the riot police lines before it lets loose so that the riot police are not “marked and soaked in tear gas.

    Another option is the use of a tanker/pumper truck with fire hoses that could be used. Multiple hose hookups could be used to used. These portable fire hoses should be used to spray in a FAN PATTERN. Remember that the point is to mark the violent protestors with dye and liquid tear gas — NOT immobilize them.

    Police should also consider the use of tanker refill trucks — if not already in use — instead of having to pull the water cannons off the line for refill. Though the dye/tear gas use will be only for short term use, it may come to a point that prolonged streams may be necessary. During past protests, we watched tanker trucks leaving the area for what we assumed were refill operations. This should never happen — under the principle of logistics filling the front’s needs.

    The police should also consider the use of portable water cannons that can be easily constructed with a aircraft type rollaround fire extinguisher. Fill the tank with water/dye/tear gas and place air head pressure on the item supplied by a portable compressor at 100psi. We invented this years ago and this works with sprays reaching 50-100 feet. With fire hose extensions, they could be fired by the riot police atop buses on protestors below.

  • 6. SET UP A MOBILE BOOKING CENTER ON SITE: Procedures need to be worked out to book the individuals ON SITE in a holding area. DO NOT TAKE THEM TO JAIL TO BECOME MARTYRS. Through the use of the telecommunications links a mobile processing center should be set up to hand the protestors. Instead of taking them to jail to book and release them — do it on location. All procedures must be reviewed before hand by the Prosecutors Office to ensure they will not be challenged later in court. If the protestors are adults, then charge them on the spot with an illegal violent act. It is up to the site commander whether the support elements people will be cited for lesser charges such as disturbing the peace as a misdemeanor or not. We would suggest that they simply be released.We recommend the Mobile Booking Center be in a bus(es) that would have been used to take the protestors to jail.
    • a. Electrical power: Electrical power would be provided by portable generators in the baggage compartment of the bus. Ensure exhaust vented outward to prevent CO poisoning.
    • b. Intranet: We suggest that the bus(es) operate on an intranet setup — and not an Internet connection to the main headquarters. The main point is to book those arrested as swiftly as possible — and then after the protest is over, the booking sheets on computers can be downloaded into the KNP mainframe. The problems of internet connections — even with wireless connections or Satellite links — is that it is unsecure. Personal data can be compromised. (NOTE: Provisions for a runner system to carry the booking sheets on disk/CD to headquarters to be loaded should in initiated. If a temporary court is established on site, one copy of the booking sheet will be required for the trial.)
    • c. Internet: Enable wireless internet capability for use in connecting to main headquarters if required. (NOTE: Internet use is most useful for on-site commanders to watch the protestor movements and plan strategies to counter them. The primary cameras will be (1) the cherry-picker camera at the bus barricade; (2) the “reporter”/cameraman on the roof of a vehicle directly behind the police line: and (3) a “reporter”/cameraman on top of the highest building in the area giving a “birds-eye” view of the protest.)
    • d. Desks/Tables for processing: The bus should be modified so that it is fully equipped with removable table tops for notebook computers. Multiple stations will aid in speeding up the processing of those arrested. Suggest ripping out all the seats and create a long table (front to rear) with benches affixed to the floor.
    • e. Thumbprint scanners: We recommend that these mobile booking centers have portable fingerprint scanners — a device that take fingerprint images by placing your thumb on the device. This thumbprint is added to the electronic booking sheet.
    • f. Webcam for Photos: We recommend a high-quality web cam be installed to take a photo of the individual that can be instantly uploaded to the electronic booking sheet. The entire process should not take more than fifteen minutes per person total.If a violent protestor is marked by dye and smell of tear gas, take pictures of them as proof of his dyed clothes and provide video taped evidence to denote they have the smell of tear gas on their person. This would be in addition to the normal booking photos for protestors. The intent is to have irrefutable proof that they were in close proximity to the violence.

      Then place them in the holding area and release them after the protest is over — or if released to a responsible adult. Send them their summons to appear in court by mail later.Ask the protestor for the name of a responsible person or relative that they can be released into the custody of. If in college, call their parents or relatives to vouch for them — by coming down to sign a release form where they are released into their custody. This is to be used for humiliation value — as most of these college students are at the protest against the wishes of their parents.

      If the protestor is a minor (middle-school or high-school), DO NOT AUTOMATICALLY RELEASE THEM AS IS THE PRESENT POLICY. Instead release them only to the custody of their parents — or the principal of their school. Their punishment will come at the hands of the parents or school principals later — out of sight of the police.

      If they are adults, they may call their wives/husbands/bosses/relatives. We assume that most adults would be hard-core activists and will refuse to cooperate so they will have to wait in a holding area until transportation to jail. However, these individuals should be run against the database for previous offenders. If found to be repeat offenders, they should be held over in jail for arraignment. We recommend that their case records also be turned over to the National Intelligence Service (NIS) and Defense Security Command (DSC) to look into these people as security risks.

      AGAIN, THE MAIN INTENT IS NOT TO TAKE THE ARRESTED PROTESTORS TO JAIL TO BECOME MARTYRS.

      Only those that refuse to cooperate should be transported to jail for booking. Do NOT allow the progressive press the opportunity to make them martyrs. At the police station, advise them that their refusal to give their identity makes them suspect as an infiltrator. If they still fail to cooperate, provide the protestor’s thumbprints to the National Intelligence Service (NIS) and/or Defense Security Command (DSC) for cross-checking of their database.

    • 7. SET UP A TEMPORARY HOLDING AREA ON SITE: Once the person is booked, we recommend placing the people in a holding area — i.e., a dead-end alley with no escape routes. Ensure the protestors have no tools to break into the adjoining rooms — i.e., tools in their back packs. Another option might be a boxed-in area of police buses with provisions to block the undercarriage area from being used for escape. (NOTE: Because these are improvised holding areas, provisions for creature comforts may be minimal. Protestors may have to use empty water bottles to urinate in and defecate into a bucket.)We recommend the holding area be at least two blocks away from the protest site, but still accessible from outside so that responsible parties can come to sign for those protestors arrested. Ensure the holding area is secure. There is a danger that the holding area can become a target of the violent protestors with the idea that they can “break them out of prison.” In past protests, we have watched the protestors chasing buses with those arrested to attempt to stop them and release the prisoners.

    B. HIT INDIVIDUAL PROTESTORS IN THE POCKETBOOK: The second phase of this “leniency” program is that the police and government should set up an active program to hit the protestors in their pocketbooks. Issue them tickets and when they show up for court, charge them with fines to offset the costs the government accrued to combat the illegal protest.

    If convicted, the city governments could also become involved in suing for such things as cleanup costs for the illegal demonstration. REMEMBER, the government must first prove that the violence was preplanned and then the person becomes a party to planned violence — regardless if he was swept up in the emotion of the moment. This is why the police MUST repeatedly make their announcements of the illegality of the protest BEFORE they take any action.

    Once convicted, ensure these protestors’ names are entered into the public record, so that a list can be obtained by shopowners who may wish to also sue to recover damages later.

    Once on the public record, we suggest that the police forward the identification information of all CONVICTED college-age protestors to the appropriate agency handling government college loans. 8 percent of all college students have government low-interest college loans. If these students are attacking the government, why should the government provide them loans? They need to learn that there are consequences to their actions. We are NOT saying take away their loans, but make them justify why they should have the loans after they willfully engage in violent activities. It is bad business practice to loan money to people who engage in high risk activities.

    Bottomline: No jail time — go after their pocketbooks.

    The Riot Police need to check with the Prosecutors Office and the Justice of Ministry on the possibility of setting up a TEMPORARY COURT for expediting the justice system. The legality of such a system needs to be asked of the Supreme Court, the Constitutional Court, Ministry of Justice and Supreme Prosecutors Office.

    The justice system in Korea is weighted towards the protection of society rather than the protection of individual rights. In most courts, the procedure is simple. The defense lawyer presents his case and the prosecution presents his case — all on paper without verbal arguments and simply by handing in a brief. The judge makes a decision based on the presentations — and usually decides, according to some, on the basis of which lawyer went to his high school/college/hometown. Regardless, “justice” is very swift and everyone is out of chambers before lunch. (NOTE: The concept of being able to face one’s accusers doesn’t really exist in Korea. Law is still a closed theater for attorneys and judges. The concept of a jury system is still in a trial basis now and will not become permanent until the distant future. The idea of “jury of one’s peers” is a foreign concept to the Korean legal system.)

    In my opinion, there should be no problem setting up such a system as an adjunct of the Seoul District Court as a “traveling court” for administrative purposes. In Korea’s history, such a system was set up in its early democratic history. We are not recommending a new system, only a different location. In other words, the same procedures will be followed, only expedited due to the special circumstances. The police would have completed the booking process on site — though not loaded into the police main computers which is an administrative matter. The defendants could be “held over for trial” in the temporary holding area. The only thing missing is the trial which as was said before is a paperwork transaction — not necessarily requiring the presence of the accused.

    The key to this would be that the Supreme Court, Constitutional Court and Ministry of Justice/Supreme Prosecutors’ Office must sign off on this idea. It may be temporary, but it must be 100 percent legal.

    The judge and prosecutor would be assigned on a rotating basis. The activists have two lawyers organizatons and they could be asked to provide defense counsel for these violent protestors. Of course, they will declare the proceedings a sham, etc. etc. — but they have a right to file an appeal on the MISDEMEANOR conviction.

    The court will be dealing only with one type of defendant. The booking sheet with modifications could be used for the court case. Using a computer, information from a booking sheet could automatically print out a charge sheet for the trial. The violent protestor stink with the dye on his clothes and the tear-gas stink — will provide his own irrefutable visual evidence of guilt. Guilt should be easy to prove and sentencing done in 5 minutes. A fine could adjudged at that point as a misdemeanor. Of course, all the guilty will be afforded an opportunity to appeal the decision of this temporary court.

    If the violent protestor is later identified as committing a violent act as shown by the videos of the protest, other charges could be added later. As he is already convicted of being at the scene of the protest with the misdemeanor fine, he can now be charged with other crimes since it has already been proved that he was at the scene of the crime. This means the police have another crack at the protestor after they get through investigating the tons of video tape evidence.

    The KNP is getting serious about the problems in the protests. It called out the old Riot Police Special Tactics unit out of “retirement.” These are some mean mothers if you’ve seen them in action.

    This is great, good job on compiling all of this!

    Kalani, the baekgoldan are the “white skull unit,” correct? Do you know when they were last used here in Korea during protests?

    Sat. the 2nd and Wed. the 6th will no doubt be big days for the protests. If the police come down hard (esp. if they used the baekgoldan), what are the chances of the organizers scoring a significant propaganda victory and hence regaining support with the broader public? This seems to me the most important thing to consider in all of this.

    Ideally, what would really be interesting is if independent journalists shadowed MBC or KBS reporting teams, and then documented what they did and didn’t cover both during the event and then in their final report. Then it would be easy to expose their one-sided reporting for all.

    The Joongang Daily says this is a “new” unit…but the protestors group say they are the Baekgoldan.

    I believe the NCOs and Officers of the “new” unit are from the old Baekgoldan. As to when I last remember them, I believe it was in the mid-1990s in the student and worker protests. After the IMF Crisis, the protests sort of fizzled out for a while. When they came back with the anti-American hate fest at the US bases in 2002, I don’t remember them being around.

    Maybe I’m wrong. Can anyone out there correct me?

    The moves are on to “hit them in the pocketbook” FINALLY. The charges will be misdemeanors as we stated and the fines will be for “obstructing the roads” etc. HOWEVER, maximum fines for a misdemeanor is very steep — but in reality, the fines will probably be modest.

    Kalani great news about issuing the fines. However I have to wonder if the police will actually issue any tickets and if there will be any penalties for not paying them? These fines are only as good as they are enforced. If they are enforced like traffic laws are enforced in Korea this will do little to curb the illegal protesters.

    This is the return of filling the fire extinguishers with part cayenne pepper and part inert fire extinguisher material. The bad part is that the pepper comes back on the police as well.

    Looks like they will be putting liquid tear gas into the water cannons — along with the dye. Don’t know if they will switch to low-pressure fan spray as we suggested or use the high pressure stream. Hope they don’t have to use it at all.

    The Seoul Metropolitan Police Agency sued three organizing groups — including the People’s Association for Measures Against Mad Cow Disease and People’s Solidarity for Participatory Democracy — and 14 leaders in the Seoul Central District Court. … Police said they are initially claiming compensation for confirmed damage of W330 million and will later add the remaining W790 million as proof becomes available.
