USFK Court Martial Results for September 2008

Another month and more court martial results. This month there was only three court martials for the usual stupid stuff. However, this month has the most ROK criminal prosecutions that I can ever remember seeing with ten cases tried. Out of those 10 convictions, three of them were for DUI’s. That now makes 20 DUI’s for USFK servicemembers in 18 months. Not good. The rest of the incidents are nothing serious, just that there was a lot of them this month. It could be because the Korean court backlogged a number of incidents from this summer to be tried in September. Anyway below are the full court martial results:

USFK Court-Martial Results for September 2008

At a general court-martial on 17 September 2008, Private James L. Bolton, Headquarters & Headquarters Company, 4-2 Aviation Regiment, Second Infantry Division, was convicted of attempted larceny, conspiracy, and larceny. His adjudged sentence was confinement for 180 days, forfeiture of all pay and allowances, and a bad-conduct discharge.

At a special court-martial on 12 September 2008, Private (E-2) Angela D. Houston, Delta Company, 302d Brigade Support Battalion, 1st Heavy Brigade Combat Team, Second Infantry Division, was convicted of assault with a dangerous weapon. She was sentenced to confinement for six months, forfeiture of $898.00 pay per month for six months, and reduction to the rank of Private E-1.

At a special court-martial on 24 September 2008, Private First Class Jacob A. Tapp, Charlie Troop, 4-7 Calvary Regiment, 1st Heavy Brigade Combat Team, Second Infantry Division, was acquitted of two charges of assault with a means likely to produce death.

Results of ROK Criminal Prosecutions for September 2008

In Seoul Central District Court on 4 September 2008, SSG Raymond R. Erickson of the Noncommissioned Officer Academy, was convicted of larceny, DUI and leaving the scene of an accident. His adjudged sentence was imprisonment for 1 year, suspended for 2 years.

In Suwon District Court on 8 September 2008, PFC Andrew E. French of Bravo Company, 3/2d General Support Aviation Battalion, was convicted of obstruction of performance official duties. His adjudged sentence was a 2,000,000 Won fine.

In Seoul Central District Court on 17 September 2008, PVT John R. Jones, Jr., of Headquarters & Headquarters Company, 8th U.S. Army, was convicted of trespass and destruction of property. His adjudged sentence was a 1,000,000 Won fine.

In Daegu District Court on 17 September 2008, PVT Jesse A. Arnold of 188th Military Police Company was convicted of a violation of the Law on Punishment of Violent Acts, etc. His adjudged sentence was a 2,000,000 Won fine.

In Daegu District Court on 17 September 2008, PVT Jose A. Avila of 188th Military Police Company was convicted of a violation of the Law on Punishment of Violent Acts, etc. His adjudged sentence was a 2,000,000 Won fine.

In Seoul Central District Court on 19 September 2008, PFC Wesley D. Nobles of 142d Military Police Company was convicted of indecent assault. His adjudged sentence was a 3,000,000 Won fine.

In Seoul Central District Court on 19 September 2008, SFC Burt T. Hensley of 121st Combat Support Hospital was convicted of DUI. His adjudged sentence was a 1,500,000 Won fine.

In Uijeongbu District Court on 23 September 2008, PVT Damien L. Baker of Headquarters & Headquarters Company, 1st Brigade Special Troops Battalion, was convicted of larceny, DUI and driving without a license. His adjudged sentence was a 5,000,000 Won fine.

In Uijeongbu District Court on 24 September 2008, PVT Adam E. Lippy of Co F, 302d Base Support Battalion, was convicted of driving without a license. His adjudged sentence was a 300,000 Won fine.

In Uijeongbu District Court on 24 September 2008, SPC Samuel D. Johnson of Bravo Battery, 1/15th Field Artillery, was convicted of inflicting bodily injury. His adjudged sentence was a 1,500,000 Won fine.

    Need anyone point out that almost all of the 20 DUIs in the last 18 months were committed by those USFK thought were unlikely to have such problems?

    Most of the DUIs are officers and senior NCOs but that is because they are the only ones authorized to own a car which skews the statistic. Even though General Sharp has now authorized anyone to get a drivers license it still doesn’t mean those servicemembers will be allowed to own a car. They still need their commanders approval and how many commanders are going to allow their privates to all own cars? Probably not many which means the majority of DUIs will probably still be senior NCOs and officers.
