Not much going on this month with USFK court martials with only two being tried. One for writing bad checks and the other for conspiracy and making a false official statement. For you young soldiers who don’t know, yes you can be court martialed for writing bad checks. Also do not lie when writing an official statement because you will get court martialed. Every soldier I know of that was caught lying on an official statement was court martialed. Lying for your buddy on an official statement is not worth it.
Though there wasn’t much USFK court martial activity there was a lot of ROK criminal prosecutions with most of them being related to fights and the soldiers given fines. However, once again this month more soldiers have been arrested for DUIs. This month both a Captain and a Sergeant Major have been arrested for DUIs. The Captain considering they list his unit as C/6-37 FA I would assume to even be a Battery Commander. Really outrageous. Overall for USFK that now makes 22 DUIs in 19 months. Not good and it also something that cannot be blamed on the lower enlisted.

USFK Court-Martial Results for October 2008
At a general court-martial on 16 October 2008, Specialist Hae R. Choi, Delta Company, 1-72d Armor Regiment, 1st Heavy Brigade Combat Team, Second Infantry Division, was convicted of five specifications of making and uttering worthless checks by dishonorably failing to maintain sufficient funds. His sentence was reduction to Private First Class (E-3).
At a special court-martial on 7 October 2008, Specialist Lance E. Lesueur, Headquarters and Headquarters Company, 4-2 Aviation Regiment, Second Infantry Division, was convicted of conspiracy and making a false official statement. His sentence was reduction to Private E-1, forfeiture of $898.00 pay per month for three months, confinement for three months, and a bad-conduct discharge.
Results of ROK Criminal Prosecutions for October 2008
In Uijeongbu District Court on 2 October 2008, PFC Ryne K. Medina of 55th Military Police Company was convicted of inflicting bodily injury. His adjudged sentence was a 1,000,000 Won fine.
In Uijeongbu District Court on 10 October 2008, PFC Joel H. Timarong of Co B, 70th Brigade Support Battalion was convicted of inflicting bodily injury. His adjudged sentence was imprisonment for 6 months, suspended for 2 years.
In Uijeongbu District Court on 10 October 2008, PVT Jeremy S. Shanley of Co B, 1/38th Field Artillery was convicted of violations of the Narcotics Control Act. His adjudged sentence was imprisonment for 2 years and 6 months, suspended for 3 years.
In Uijeongbu District Court on 10 October 2008, SGM Marshall O. Downs of US Army Garrison-Red Cloud was convicted of DUI. His adjudged sentence was a 1,500,000 Won fine.
In Suwon District Court on 10 October 2008, PVT Devin J. Ormand of Co A, 602d Aviation Support Battalion was convicted of inflicting bodily injury. His adjudged sentence was a 2,000,000 Won fine.
In Suwon District Court on 13 October 2008, CPT Kyle R. Luoma of Co B, 2/2d Aviation was convicted of a traffic law violation. His adjudged sentence was a 1,000,000 Won fine.
In Uijeongbu District Court on 13 October 2008, PVT Elias Ramos of Headquarters and Headquarters Company, 1st Heavy Brigade Combat Team was convicted of destruction of property. His adjudged sentence was a 3,000,000 Won fine.
In Suwon District Court on 16 October 2008, PFC Sean M. Chastain of Co B, 532d Military Intelligence Battalion was convicted of a violation of the Act on Punishment of Violent Acts. His adjudged sentence was a 1,000,000 Won fine.
In Seoul Central District Court on 21 October 2008, PFC Sean A. Pate of Headquarters Service Company, 602d Aviation Support Battalion was convicted of fraud and violations of the Specialized Credit Financial Business Act. His adjudged sentence was a 2,500,000 Won fine.
In Seoul Central District Court on 27 October 2008, CPT Martin B. Mendez of Battery C, 6/37th Field Artillery was convicted of DUI. His adjudged sentence was a 1,500,000 Won fine.

Over the past 17+ years, I’ve seen two sergeants major get DUI’s…they just moved to a different battalion and right back into the CSM position! Must be nice to have job security like that. Not sure about Downs, but he’s been in Korea so long he’ll probably do the same.
