USFK Court Martial Results for March 2009

Well we know about the mandatory weekend training ordered by USFK Commander General Sharp because of the steep rise in incidents since he lifted the curfew.  The March 2008 court martial results give you some idea of how sharply these incidents have increased.  Incredibly there was a total of 4 DUI’s last month.  That makes 32 DUI convictions in the past 24 months and a total of 8 already this year.

USFK Court Martial Results

At a special court-martial on 13 March 2009, Specialist Logan Holland, Foxtrot Company, 302d Brigade Support Battalion, 1st Heavy Brigade Combat Team, Second Infantry Division, was convicted of conspiracy to commit larceny, larceny of an amount more than $500, and violation of a lawful general regulation.  He was sentenced to reduction to Private E1, confinement for ten (10) months, and a bad-conduct discharge.

At a general court-martial on 17 March 2009, Specialist Kenard L. Brown, 142d Military Police Company, 94th Military Police Battalion, United States Army Garrison-Yongsan, Eighth United States Army, was convicted of two specifications of assault consummated by battery, assaulting a noncommissioned officer, disrespecting a noncommissioned officer, and signing a false official record.  He was sentenced to reduction to Private E1, confinement for ten (10) months, and a bad-conduct discharge.

At a special court-martial on 25 March 2009, Staff Sergeant Benjamin R. Osborne, Charlie Troop, 4th Battalion, 7th Calvary Regiment, 1st Heavy Brigade Combat Team, Second Infantry Division, was convicted of assault consummated by battery.  He was sentenced to reduction to Specialist (E4) and confinement for 15 days.

At a general court-martial on 26 March 2009, Captain Christopher Gray, Headquarters and Headquarters Detachment, 25th Transportation Battalion, 19th Sustainment Command (Expeditionary), was convicted of murder and wrongful disposal of a body.  He was sentenced to life imprisonment (with eligibility for parole), total forfeiture of all pay and allowances, a reprimand, and dismissal from the service.

Results of ROK Criminal Prosecutions for March 2009

In Suwon District Court on 5 March 2009, PFC Joshua N. Fahy, Bravo Company, 532d Military Intelligence Battalion, was convicted of a traffic law violation (driving without a license).  His adjudged sentence was a 1,000,000 Won fine.

In Suwon District Court on 6 March 2009, SPC Lawrence E. Brown, Echo Company, 3-2d General Support Aviation Battalion, was convicted of infliction of bodily injury.  His adjudged sentence was a 2,000,000 Won fine.

In Suwon District Court on 6 March 2009, CW2 Desmond E. Ray, Co C, 3-2d General Support Aviation Battalion, was convicted of DUI.  His adjudged sentence was a 1,500,000 Won fine.

In Seoul Central District Court on 12 March 2009, SFC Felix E. Rodriguez, Headquarters and Headquarters Company, 1st Signal Brigade, was convicted of DUI.  His adjudged sentence was a 1,000,000 Won fine.

In Seoul Central District Court on 13 March 2009, PO2 Amelino R. Jimenez, Special United States Liaison Activity Korea, Yongsan, was convicted of DUI.  His adjudged sentence was a 1,500,000 Won fine.

In Seoul Central District Court on 13 March 2009, CPO Jacques A. White, CNFK (duty with HQ USFK (J33), was convicted of DUI.  His adjudged sentence was a 700,000 Won fine.

In Seoul Central District Court on 23 March 2009, PFC Kelly O. Stark, 142d Military Police Company, was convicted of assault and destruction of property.  His adjudged sentence was a 1,000,000 Won fine.

In Seoul Central District Court on 23 March 2009, SPC Nicholas T. Smith, Bravo Company, 121st Combat Support Hospital, was convicted of infliction of bodily injury.  His adjudged sentence was a 1,000,000 Won fine.

In Wonju Branch Court of the Chunchon District Court on 27 March 2009, SPC Theodore Z. Miller , 75th Medical Company, was convicted of a violation of the Narcotics Control Law.  His adjudged sentence was a 3,000,000 Won fine.
