The USFK court martial results were posted a little late this month on the USFK website but they are up now for everyone to look at.  Some of the court martial results people should already be familiar with if you have been reading the site regularly such as the conviction of the Yongsan First Sergeant.  In the ROK criminal prosecutions you can easily see why the USFK commander is so concerned about off post indisciplince considering the number of convictions.  Most of them follow the pattern I mentioned before of increases in traffic related incidents and bodily injury cases.  There was also two more DUI’s this month making it 10 DUI’s already this year.

USFK Court Martial Results

At a Special court-martial on 2 April 2009, Airman First Class Charles T. Walker Jr., 51st Security Forces Squadron, Osan Air Base, was convicted of wrongful appropriation of a firearm, wrongful and willful discharge of a firearm, and unlawful carrying of a concealed weapon.  He was sentenced to confinement for 100 days and reduction to Private E1.

At a special court-martial on 3 April 2009, Master Sergeant Michelle A. Morales, 19th Adjutant General Company, Special Troops Battalion-Korea, United States Army Garrison-Yongsan, Eighth United States Army, was convicted of three specifications of violating a lawful general regulation by wrongfully engaging in a prohibited relationship with her subordinates.  She was sentenced to reduction to Sergeant First Class (E7) and a reprimand.

At a special court-martial on 10 April 2009, Private First Class Mandela C. Williams, Headquarters and Headquarters Company, Special Troops Battalion-Korea, Eighth United States Army, was acquitted of aggravated sexual assault.

At a general court-martial on 17 April 2009, Staff Sergeant Steven N. Jacques, 629th Medical Company, 168th Medical Battalion, Second Infantry Division, was convicted of committing sodomy and an indecent act.  He was sentenced to reduction to Private E2 and confinement for six months.

At a general court-martial on 22 April 2009, Staff Sergeant (Deleted by Request), 142d Military Police Company, 42d Military Police Battalion, Eighth United States Army, was convicted of dereliction of duty, wrongful appropriation of Overseas Housing Allowance in an amount more than $500, absence without leave, and making a false official statement.  He was sentenced to reduction to Private (E1), confinement for four months, and a bad-conduct discharge.

At a special court-martial on 24 April 2009, Private Sammir A. Wallace, Headquarters and Headquarters Detachment, 121st Combat Support Hospital, 65th Medical Brigade, Eighth United States Army, was convicted of assault consummated by battery and failure to report.  He was sentenced to confinement for six months.

Results of ROK Criminal Prosecutions

In Suwon District Court on 30 March 2009, MSgt Barry A. Wenink, 7th Air Force, was convicted of DUI, BAC-0.078%.  His adjudged sentence was a 700,000 Won fine.

In Seoul Central District Court on 31 March 2009, SSG Billy L. Swanigan, Jr., STB-K, was convicted of a vehicular hit and run resulting in personal injury.  His adjudged sentence was imprisonment for one year, suspended for two years.

In Seoul Central District Court on 1 April 2009, SGT Jonathan J. McCarroll, HHD, 121st CS Hospital, was convicted of traffic law violations.  His adjudged sentence was a 700,000 Won fine.

In Wonju Branch of Chuncheon District Court on 3 April 2009, SPC Brice D. Marshall, 75th Medical Company, was convicted of drug law violations.  His adjudged sentence was a 4,000,000 Won fine.

In Wonju Branch of Chuncheon District Court on 3 April 2009, SPC Theodore A. Miller, 75th Medical Company, was convicted of drug law violations.  His adjudged sentence was a 3,000,000 Won fine.

In Suwon District Court on 20 April 2009, SFC (Deleted by Request), 520th Maintenance Company, was convicted of DUI, BAC-0.055% .  His adjudged sentence was a 700,000 Won fine.

In Seoul Central District Court on 21 April 2009, SPC Joshua A. Garcia, 595th Maintenance Company, was convicted of arson, intrusion of a human habitation and destruction of property.  His adjudged sentence was a 3,000,000 Won fine.

In Seoul Central District Court on 27 April 2009, PFC Joshua J. Jordan, 19th AG Company, was convicted of a violation of infliction of bodily injuries.  His adjudged sentence was a 3,000,000 Won fine.

In Seoul Central District Court on 27 April 2009, PFC Michael A. Small, HHC, STB-K, was convicted of infliction of bodily injuries.  His adjudged sentence was a 1,000,000 Won fine.

In Seoul Central District Court on 27 April 2009, SSG Billy L. Swanigan, Jr, STB-K, was again convicted of assault, infliction of bodily injury and obstruction of performance of official duties.  His adjudged sentence was a 3,000,000 Won fine.

In Seoul Central District Court on 28 April 2009, SFC Kelli R. Daniels, Co B, 121st CS Hospital, was convicted of a vehicular hit and run resulting in personal injury.  Her adjudged sentence was imprisonment for one year, suspended for two years.
