USFK Court Martial Results for July 2009

In this month’s court martial results there was not really anything that really stood out with people doing the typical stupid stuff.

Court-Martial Results for July 2009

At a special court-martial on 2 July 2009, Specialist Kenneth D. Jenkins, Army Element, Special Operations Command Korea, Eighth United States Army, was convicted of assault consummated by battery.  He was sentenced to reduction to Private E1 and confinement for sixty (60) days.

At a general court-martial on 9 July 2009, PVT Enrique G. Vizcarra, Echo Company, 4-2 Aviation Regiment, 2d Combat Aviation Brigade, 2d Infantry Division, was found not guilty of wrongful sexual contact, indecent acts, rape and aggravated sexual assault.

At a general court-martial on 16 July 2009, CW2 (Name removed by request)., Headquarters and Headquarters Company, 3-2 General Support Aviation Battalion, 2d Infantry Division, was found guilty of four specifications of wrongful appropriation of currency of a value of more than $500.00.  He was sentenced to confinement for twelve (12) months and a dismissal from the Army.

At a special court-martial on 20 July 2009, Private First Class Christopher A. Johnson, 142nd Military Police Company, 94th Military Police Battalion, Eighth United States Army, was convicted of assault consummated by battery.  He was sentenced to reduction to Private E2, and confinement for 30 days.

At a special court-martial on 22 July 2009, Sergeant Darren L. Clay, Headquarters and Headquarters Detachment, 94th Military Police Battalion, Eighth United States Army, was convicted of assault consummated by battery.  He was sentenced to reduction to Specialist and confinement for 20 days.

ROK Criminal Prosecution Results for July 2009

In Uijeongbu District Court on 1 July 2009, PVT Taft R. Cope, G Co, 302d BSB, 2d Infantry Division, was convicted of larceny.  His adjudged sentence was a 500,000 Won fine.

In Gunsan Branch of Jeonju District Court on 7 July 2009, A1C Antonio L. Smith, 8th SFS, 8th FW, was convicted of inflicting bodily injury.  His adjudged sentence was a 2,000,000 Won fine.

In Seoul Central District Court on 9 July 2009, MSG Luis A. Figueroa-Bonilla of IMCOM-K, USAG-Yongsan, was convicted of a violation of the Act on Aggravated Punishment for Specified Crimes (leaving the scene of an accident).  His adjudged sentence was imprisonment for one year, not suspended.

    …but he just took a huge pay cut from E-8 to E-6 for the rest of his life when he does retire.

    Wouldn't he retire (assuming he is able to finish out 20 years) at the highest rank held during his career – and not necessarily the one he held at the time of retirement?

    Does anyone know what a fella needs to do to get "His adjudged sentence was imprisonment for one year, not suspended." tacked onto a sentence? Did he refuse to pay someone off? I would like to know the story behind that – he must have pissed the wrong guy off.

    I think you have to petition the Board of Correction of Military Records after you retire at the lower rank.

    Not sure it's corruption- more like institutionalized apathetic incompentence, with occasional forays into corruption.

    Hanlon's Razor (though I prefer to attribute it to Robert A. Heinlein) ok…

    Heinlein's Razor comes into play here:

    "Never attribute to malice that which can be adequately explained by stupidity, but don't rule out malice."

    Either (malice or incompetence) should be exposed and punished, or dealt with appropriately, as the case may be.
