Court-Martial Results for October 2009

At a general court-martial on 2 October 2009, Airman First Class Rashaan L. Swann, 8th Logistics Readiness Squadron (PACAF), Kunsan Air Base, United States Air Force, was acquitted of rape and forcible sodomy.

At a special court-martial on 5 October 2009, Sergeant Markease K. Joyner, Headquarters and Headquarters Company, 501st Military Intelligence Brigade, Eighth United States Army, was convicted of assault consummated by battery.  He was sentenced to reduction to the grade of Private E-1, forfeiture of $300.00 per month for three months, and confinement for 100 days.

At a special court-martial on 9 October 2009, Private First Class Christopher A. Wright, 563rd MEDLOG Company, 168th MMB, 19th Expeditionary Sustainment Command, was convicted of four specifications of absence without leave (AWOL).  He was sentenced to reduction to Private E-1, confinement for 60 days, and a bad-conduct discharge.

At a special court-martial on 19 October 2009, Private First Class Jamaine D. Woodard, Alpha Forward Support Company, 70th Brigade Support Battalion, 210th Fires Brigade, 2d Infantry Division, was convicted of two specifications of disrespect towards a noncommissioned officer, violation of a lawful general order, and two specifications of assault consummated by battery.  He was sentenced to reduction to Private E-1 and confinement for 30 days.

At a special court-martial on 23 October 2009, Sergeant Colin H. Robinson, Headquarters and Headquarters Detachment, 41st Signal Battalion, 1st Signal Brigade, Eighth United States Army, was convicted of two specifications of assault consummated by battery and failure to obey a lawful order.  He was found not guilty of two specifications of assault with a dangerous weapon.  He was sentenced to reduction to Specialist (E-4).

At a summary court-martial on 29 October 2009, Airman Justin T. Tuazon, 51st Security Forces Squadron, United States Air Force, was convicted of larceny. He was sentenced to reduction to E1, forfeiture of 2/3 pay for one month, and confinement for 30 days.

At a general court-martial on 30 October 2009, Staff Sergeant Lawrence J. Lavergne, Echo Company, 302d Brigade Support Battalion, 1st Heavy Brigade Combat Team, Second Infantry Division, was found guilty of Aggravated Sexual Assault, housebreaking, and adultery.  He was sentenced to reduction to Private E1, forfeiture of all pay and allowances, confinement for 36 months, and a Bad-Conduct Discharge.

ROK Criminal Prosecution Results for October 2009

In Seoul Central District Court on 8 October 2009, SSG Isaac M. Jackson, 121st CS Hospital, was convicted of infliction of bodily injury.  His adjudged sentence was a 1,500,000 Won fine.

In Uijeongbu District Court on 12 October 2009, SSG Arturo DeSantiago, 61st Maintenance Company, was convicted of DUI.  His adjudged sentence was a 1,500,000 Won fine.

In Seoul Central District Court on 15 October 2009, SPC Rotirius E. Morgan, B Det, 176th Finance Company, was convicted of embezzlement and credit card fraud.  His adjudged sentence was a 1,000,000 Won fine.

In Seoul Central District Court on 16 October 2009, SPC Andrew L. Loper, 142d MP Company, was convicted of larceny.  His adjudged sentence was a 1,000,000 Won fine.

In Seoul Central District Court on 19 October 2009, PFC Lella A. Stevens, 618th Dental Company, was convicted of vehicular hit and run.  Her adjudged sentence was a 3,000,000 Won fine.

In Seoul Central District Court on 21 October 2009, PV2 James M. Ozbirn, 595th Maintenance Company, was convicted of a violation of the Act on Punishment of Violent Acts.  His adjudged sentence was a 2,000,000 Won fine.

In Seoul Central District Court on 28 October 2009, PV2 Joshua A. Dillon, HHB, 6/52d AMD, was convicted of larceny.  His adjudged sentence was a 700,000 Won fine.

In Daegu District Court on 30 October 2009, PVT Isaac Yanez, 293d Signal Company, was convicted of robbery, burglary, larceny, DUI, and driving without license.  His adjudged sentence was imprisonment for two years and six months, suspended for three years.
