A Chinese woman in New York made the mistake of telling a Judge she don’t admire ‘African-Americans, Hispanics and Haitians.’
An incensed federal judge sentenced a racist Brooklyn woman to indefinite jury duty on Tuesday after she trashed the NYPD and minorities.
“This is an outrage, and so are you!” Federal Judge Nicholas Garaufis told the woman, holding up her bile-filled juror questionnaire.
Juror No. 799, an Asian woman in her 20s who said she works in the garment industry, was up for jury duty in the death penalty trial of Bonanno crime boss Vincent (Vinny Gorgeous) Basciano.
It didn’t take long for her to start looking worse than the defendant.
Asked to name three people she least admired, she wrote on her questionnaire: “African-Americans, Hispanics and Haitians.”
When the judge asked why she answered the question that way, she replied, “You always hear about them in the news doing something.”
She also declared that cops are all lazy, claiming that they sound their sirens to bypass traffic jams.
Garaufis flipped forward several pages in her questionnaire.
He landed on the page where she had said she had a relative who was a member of the Chinese Ghost Shadows gang in the 1980s, convicted of murder and still in prison.
“Why didn’t you put ‘Asians’ down also?” the judge asked sarcastically, referring to her list of least-liked people.
“Maybe I should have,” she said.
Assistant U.S. Attorney Taryn Merkl requested that the woman be disqualified from the Vinny Gorgeous case because of her “inappropriate” comments. The motion was granted.
It is not unheard of for people to try to get out of jury service by making ridiculous statements concerning their views.
It was unclear Tuesday whether that was this woman’s motive.
And if it was, it didn’t work.
Indeed, the woman was going to be seeing a lot of Brooklyn Federal Court.
“She’s coming back [today], Thursday and Friday – and until the future, when I am ready to dismiss her,” Garaufis said.- New York Daily News
Under what authority Judge Garaufis can you order a person back to your court? Oh Judges are Gods and they can do whatever the hell they please and take away other people’s liberties and destroying lives in the process if they want and still several years later be able to walk out of court after being convicted of a crime.
Update- The Judge has reversed course but I still think his actions are inexcusable. As one Law Professor said ” She can’t be punished for being a racist,” Gillers said. “You don’t check the First Amendment at the courtroom door.”
Did anyone prove the statements on the questionaire weren’t true? If the woman believed what she wrote, how is that a crime?
As you can tell, I’m not a big fan of Judges. Or the legal profession in general.

He couldn't do so, and he relented. However, she did fail to perform her duty as a citizen and hinder the court proceedings. Giving her an extra week of jury duty would only be fair, but as it is she got off with just losing her jury stipend.

Even before I read the update, I was thinking to myself, "He can't do that; it's illegal."
But the woman was remiss for how she worded her get-out-of-jury-duty statement.
Quoting Homer Simpson: "The trick is to say you're prejudiced against all races."

funny just saw on the news this morning thathispanics and blacks make up 33 percent of the US population but close to 80 percent of the prison population so if she quoted this stat to the judge i wonder what his response would be

#1 She did NOT fail to do her duty. She made it known that she was not FIT for this duty. Two very different things. If you're over 15 yoa you should know that!
Under what rules would giving her a week of jury duty be a good thing? Or even an intelligent action! How is that in any way "fair". She isn't fit for the duty. She was honest about it. What the hell is wrong with YOU?

Judges do feel the have the ability to overide your rights. She felt that way and she has the right to express it.

(Lawyer speaking here) She's free to be a racist and have her opinions. If she's being frank, the Judge can't touch her. If she deliberately lying on the questionnaire, she can be punished for contempt of court. If it's clear from her statements that her "racism" is a ruse (and it sounds like she let the mask slip a little with her response about Asians), then she's fair game. Punishable or not, this woman's a jackass. The judge is a jackass too because making her come in every day just to get dismissed in voir dire would have wasted the time and money of a lot of people other than her.

Hmmm…
I sat in on low-level court a number of times.
Many people were disrespectful and argumentative.
I was quite surprised at how patient the judges (of all genders and races) were with this and how they tried to explain why the defendant's action was considered an offense.
People who listened respectfully, admitted their mistakes, and demonstrated that they understood the nature of their offense, got reduced or dismissed punishment. Those who argued and made continuous excuses got the full treatment.
Although there was some serious white trash, generally, the white people dressed for the occasion and were respectful to the judge in their speaking and action.
A MUCH higher percentage of the blacks and Mexicans were disrespectful, dismissive, and argumentative… and they received higher rates of punishment.
These aspects of certain subsets of American black and Hispanic culture, encouraged by "tolerance", likely play a role in the disparity in prison population statistics.

The Judge was blowing off steam, he obviously thought she said all that to get out of jury duty and poped a cork. Yes we all know he can't order her on jury duty, hence the later reversal. The most he can do is get her on contempt and throw a monetary fine / community service at her. I'm for the community service part, always though making people work in their free time was more educational then making them pay a fine.

Typical Chinese, they love our Country for the Green (Money), they don't believe in the US Constitution. They don't drive American Cars, this Asain woman in the garmet industry and probably part of the Chinese illegal garmet knock off scheme that originates in China.
