Below are the May 2011 court martial results and ROK criminal prosecutions. There was plenty to keep the USFK JAG offices busy last month. Something that really jumped out last month is that it appears that USFK is really cracking down on the use of Spice by its servicemembers. Also what is up with the perverts this past month? In the ROK criminal prosecution front it was once again mostly a bunch of driving related infractions with an incredible 6 DUI’s last month:
May 2011 USFK Court Martials
At a special court-martial on 3 May 2011, SFC Jammie B. Lowe, 595th Maintenance Company, 498th Command Sustainment Support Battalion, 501st Sustainment Brigade, was convicted of 2 specifications of absence from his unit. He was sentenced to 30 days confinement.
At a summary court-martial on 4 May 2011, SPC Joseph B. Honaker, 55th Military Police Company, 94th Military Police Battalion, 501st Sustainment Brigade, was convicted of 1 specification of violation of a lawful general order by wrongfully smoking “spice,” 1 specification of wrongful use of drugs, to wit: Adderall, 1 specification of simple assault, 2 specifications of assault consummated by battery, and 2 specifications of aggravated assault, and acquitted of 2 specifications of assault consummated by battery. He was sentenced to reduction to E-3 and restriction to the limits of Camp Casey for 45 days.
At a summary court-martial on 10 May 2011, PFC Joshua L. Martin, 557th Military Police Company, 94th Military Police Battalion, 501st Sustainment Brigade, was convicted of 1 specification of attempt to aid and abet another Soldier in violating a lawful general regulation, to wit: USFK Command Policy #55, Prohibited Substances, by wrongfully selling to another Soldier Tramadol, a prescription medication, to be used in a manner contrary to its intended medical purpose, 2 specifications of attempt to violate a lawful general regulation, to wit: USFK Command Policy #55, Prohibited Substances, by wrongfully possessing substances believed to be “spice” and Tramadol with intent to use to alter mood or function, 1 specification of attempt to violate a lawful general regulation, to wit: AR 600-85, The Army Substance Abuse Program, by wrongfully using a substance believed to be Tramadol, 1 specification of providing another Soldier a substance believed to be Tramadol, 2 specifications of selling to another Soldier a substance believed to be “spice,” 2 specifications of wrongfully possessing a substance believed to be “spice” with intent to use, 1 specification of selling to another Soldier a substance believed to be Tramadol, 1 specification of wrongful use of a substance believed to be Tramadol, and 1 specification of wrongful possession of substance believed to be Tramadol to be used contrary for its intended medical purpose. He was sentenced to reduction to E-1, forfeiture of $978 pay per month for one month, and 30 days confinement.
At a special court-martial on 11 May 2011, PVT Sidney D. Taylor, 348th Quartermaster Company, 194th Combat Sustainment Support Battalion, 501st Sustainment Brigade, was convicted of 1 specification of conspiracy to commit larceny, 1 specification of conspiracy to commit obtaining services under false pretenses, 1 specification of wrongful appropriation, 2 specifications of larceny, and 1 specification of obtaining services under false pretenses, and acquitted of 1 specification of violating a lawful general regulation, 1 specification of making a false official statement, 1 specification of adultery, 1 specification of assault consummated by battery, and 1 specification of failure to obey a lawful order. He was sentenced to confinement for five months and a Bad-Conduct Discharge.
At a summary court-martial on 16 May 2011, PVT Jeremy S. Jagielski, G Company, 302d Brigade Support Battalion, 1st Heavy Brigade Combat Team, was convicted of 1 specification of assault consummated by battery, 1 specification of violation of the general article, and 1 specification of willful disobedience of a superior commissioned officer, and acquitted of 1 specification of resisting apprehension. He was sentenced to forfeiture of two-thirds pay for one month and 30 days confinement.
At a summary court-martial on 16 May 2011, PVT Shane M. Marcus, C Company, 2d Battalion, 9th Infantry, 1-72 Armor Regiment, 1st Heavy Brigade Combat Team, was convicted of 2 specifications of attempt to violate a lawful general order, to wit: USFK Command Policy #55, Prohibited Substances, 2 specifications of violating a lawful general order to wit: USFK Command Policy #55, Prohibited Substances, for possessing and distributing “spice,” 1 specification of wrongful distribution of “spice,” and 1 specification of wrongful possession of “spice” with intent to distribute. He was sentenced to forfeiture of $968 pay for one month and 30 days confinement.
At a special court-martial on 18 May 2011, PFC Shavella T. Gunsby, Headquarters and Headquarters Company, 194th Combat Sustainment Support Battalion, 501st Sustainment Brigade, was convicted of 1 specification of conspiracy to commit wrongful appropriation, 1 specification of wrongful appropriation, and 1 specification of adultery, and acquitted of 1 specification of conspiracy to commit larceny, 1 specification of conspiracy to commit obtaining services under false pretenses, 1 specification of making a false official statement, 1 specification of larceny, and 1 specification of obtaining services under false pretenses. She was sentenced to 45 days confinement.
At a general court-martial on 19 May 2011, PFC Andre R. Dashiell, A Company, 602d Aviation Support Battalion, 2d Combat Aviation Brigade, was convicted of 4 specifications of failure to obey a lawful order, to wit: no contact orders, and 1 specification of indecent acts, to wit: placing his penis in a Soldier’s mouth in the exposed view of others, and acquitted of 1 specification of conspiracy to commit aggravated sexual assault. He was sentenced to reduction to E-1, 3 years confinement, and a Bad-Conduct Discharge.
At a general court-martial on 20 May 2011, PVT Jonathan Delacruz, Battery B, 1st Battalion, 15th Field Artillery, 1st Heavy Brigade Combat Team, was convicted of 3 specifications of assault consummated by battery and acquitted of 2 specifications of wrongful sexual contact, 1 specification of indecent exposure, and 2 specifications of abusive sexual contact. He was sentenced to forfeiture of all pay and allowances, 4 months confinement, and a Bad-Conduct Discharge.
At a special court-martial on 20 May 2011, TSgt Charles G. Harding, 607th Air and Space Operations Center/CC, was convicted of 2 specification of dereliction of duty, 1 specification of violating a general regulation, to wit: USFK Regulation 60-1, Ration Control Policy Access to Duty-Free Goods, 2 specifications of making worthless checks with intent to defraud, and 15 specifications of dishonorably failing to pay a debt. He was sentenced to reduction to E-4, restriction to the limits of Osan Air Base for 60 days, and a reprimand.
At a special court-martial on 21 May 2011, SrA Nicholas W. Spray, 51st Maintenance Squadron/CC, was convicted of 6 specifications of indecent acts, to wit: recording video of a male Airman’s genitalia and buttocks and a female Airman’s genitalia, buttocks, and nipples, without their consent, viewing videos showing two Airmen engaging in sexual acts, without their consent, etc. He was sentenced to reduction to E-1, 180 days confinement, and a Bad-Conduct Discharge.
Results of ROK Criminal Prosecutions for May 2011
In Suwon District Court on 3 May 2011, PFC Joshua L. Martin, 557th MP Company, USAG-Humphreys, was convicted of DUI. His adjudged sentence was a 3,000,000 Won fine.
In Suwon District Court on 3 May 2011, SFC Anita R. Faust, HSC, 3d MI Battalion, USAG-Humphreys, was convicted of DUI. Her adjudged sentence was a 3,000,000 Won fine.
In Suwon District Court on 3 May 2011, SPC Ari A. Floyd, 501st Signal Company, USAG-Humphreys, was convicted of traffic law violations. His adjudged sentence was a 3,000,000 Won fine.
In Uijeongbu District Court on 6 May 2011, SPC Dennis J. Randle, 46th Transportation Company, USAG-Red Cloud, was convicted of DUI. His adjudged sentence was a 1,000,000 Won fine.
In Seoul Central District Court on 6 May 2011, PFC Timothy R. Greenage, 362d Signal Company, USAG-Yongsan, was convicted of Infliction of Bodily Injury. His adjudged sentence was a 1,500,000 Won fine.
In Uijeongbu District Court on 6 May 2011, SGT Marvin R. Tindle, HHC, STB-K (J-63), USAG-Yongsan, was convicted of DUI. His adjudged sentence was a 1,500,000 Won fine.
In Uijeongbu District Court on 6 May 2011, SSG Donald L. Melendy, HHC, 1/72d Armor, USAG-Casey, was convicted of DUI. His adjudged sentence was a 700,000 Won fine.
In Seoul Central District Court on 6 May 2011, PFC Jeffery C. Bryant, 595th Maintenance Company, was convicted of traffic law violations. His adjudged sentence was a 1,500,000 Won fine.
In Seoul Central District Court on 6 May 2011, Major April R. Verlo, 5th Medical Detachment, USAG-Yongsan, was convicted of Infliction of Bodily Injury through Negligence. Her adjudged sentence was a 1,000,000 Won fine.
In Seoul Central District Court on 6 May 2011, SPC Rashad J. Vereen, D Co, 302d BSB, USAG-Casey, was convicted of DUI. His adjudged sentence was a 1,500,000 Won fine.
In Seoul Central District Court on 6 May 2011, SrA Brandon L. McDonough, 51st Communications Squadron, Osan Air Base, was convicted of Obstruction of Performance of Official Duties. His adjudged sentence was a 1,000,000 Won fine.
In Seoul Central District Court on 12 May 2011, SGT April D. Reed, SOCKOR, USAG-Yongsan, was convicted of Hit and Run. Her adjudged sentence was a 5,000,000 Won fine.
In Suwon District Court on 18 May 2011, PVT Antonio M. Magana, 138th MCT, 25th Trans Bn, was convicted of Bodily Injury Resulting from Robbery. His adjudged sentence was imprisonment for 6 years.
In Daegu District Court on 18 May 2011, SPC Dustin B. Halcom, HHD, 498th CSSB, was convicted of traffic law violations. His adjudged sentence was a 1,000,000 Won fine.
In Suwon District Court on 19 May 2011, SGT Taborri L. Lindsey, B Co, 3d MI Battalion, USAG-Humphreys, was convicted of Hit and Run. His adjudged sentence was a 5,000,000 Won fine.
In Uijeongbu District Court on 23 May 2011, SPC Victor A. Burnett, Jr., C Co, DSTB, USAG-Casey, was convicted of traffic law violations. His adjudged sentence was a 1,000,000 fine.
In Uijeongbu District Court on 25 May 2011, SPC Jereme A. Hagwood, B Co, 1/38th Infantry, USAG-Casey, was convicted of Destruction of Property. His adjudged sentence was a 500,000 Won fine.

It is refreshing to see a female convicted on an adultery charge. If we are going to enforce puritan religious laws in the military, they should be applied equally.

Or could that be the TDC grandma robbery/rape case? I think not since GI Korea would have pointed it out, plus the trial was held in Suwon, not Uijeongbu (unless they change venues to keep things fair, which I also doubt). I have to agree with Leon on this one. As to the drug offenses, do we really need that kind of folk in our military? It’s truly a cross-section of American society. I think USFK should do their part in the drawdown and just kick these folks to the curb.

That guy got seven years, but this guy in Suwon must have did something similar to get such a large jail sentence. It surprising that we haven’t heard anything about this one.

#10 – Thanks for clearing that up, GI-K. I should have researched a bit more before posting, but I get lazy sometimes… Don’t think that guy got as much time as he deserved, but I suppose as long as the protest-tending populace is happy, we can all call it good.
#8 – Interesting thought…but I’d say this would only be possible if this dude was a ‘Ko-merican’, which at least on the surface, with a name of “PVT Antonio M. Magana” I would say he’s not. What’s really got my interest peaked on this one is that nothing at all was reported about this guy in S&S, no Korean media outrage at whatever heinous act this guy supposedly perpetrated, and the (for Korea) unusually long jail sentence in a Korean jail. This always takes you back to:
1) Should we be glad that another scuzz-bucket of a Soldier was sent up the river – good riddance?
or
2) Did this guy get railroaded and the silence from both sides is part of the cover-up?
