Here are the court martial results and ROK criminal prosecutions for last month.  The number of DUI’s is disturbing with seven more of them occurring last month.  There was also a few more people court martialed for distributing “Spice”:

Results of USFK Courts-Martial Convictions for October 2011

At a General Court-Martial on 5 October 2011, SPC Justin A. Peavy, A Battery, 6th Battalion, 52d Air Missile Defense, 35th Air Defense Artillery Brigade, was found guilty of one specification of violating a lawful general order by wrongfully possessing Spice with intent to use in a manner that would alter mood or function, in violation of Article 92, UCMJ; one specification of wrongful introduction of approximately two-hundred and
thirty (230) grams of Spice onto an installation under control of the armed forces, in violation of Article 134, UCMJ; and five specifications of wrongful distribution of Spice, in violation of Article 134, UCMJ.  He was sentenced to ninety (90) days of confinement, reduction to the grade of E-1, and to be discharged from the service with a Bad-conduct Discharge.

At a Summary Court-Martial on 7 October 2011, SPC Brandon C. Tittle, A Battery, 6th Battalion, 52d Air Missile Defense, 35th Air Defense Artillery Brigade, was found guilty of three specifications of assault consummated by battery, in violation of Article 128, UCMJ; one specification of communicating a threat, in violation of Article 134, UCMJ; and one specification of drunk and disorderly, in violation of Article 134, UCMJ.  He was sentenced to thirty (30) days of confinement, reduction to the grade of E-1, and forfeiture of $978 pay for one month.

At a Summary Court-Martial on 14 October 2011, SPC Andre Winslow, 348th  Quartermaster Company, 194th Combat Sustainment Support Battalion, 501st  Sustainment Brigade, was found guilty of violating a lawful order prohibiting unapproved travel out of USAG-Humphreys in violation of Article 92, UCMJ; underage drinking in violation of Article 92, UCMJ; resisting apprehension in violation of Article 95, UCMJ; fleeing apprehension in violation of Article 95, UCMJ; 2 specifications of making a false official statement in violation of Article 107, UCMJ; wrongfully possessing “spice” in violation of Article 112a, UCMJ; 2 specifications of wrongfully distributing “spice” in violation of Article 112a, UCMJ, and urinating in an alley in violation of Article 134, UCMJ.  He was sentenced to reduction to E-1, forfeiture of $1342.00 pay for one month, and 60 days restriction.

At a General Court-Martial on 20 October 2011, SGT Castillo, Eric, F Co., 3-2 GSAB, 2CAB, 2d Infantry Division, was found guilty of Rape, in violation of Article 120, UCMJ; and Aggravated Assault, in violation of Article 128, UCMJ.  He was sentenced to 2 years of confinement, reduction to the grade of E-1, and to be discharged from the service with a Dishonorable Discharge.

At a General Court-Martial on 25 October 2011, the Charge and Specifications under UCMJ Article 134, relating to possessing and receiving child pornography against SPC Crocker, Shawn A., HSC, HHB, USAGY, were dismissed with prejudice.  As a result of the dismissal, no punishment was adjudged.

Results of ROK Criminal Prosecutions for October 2011

In Uijeongbu District Court on 4 October 2011, PFC Travis J. Polovich, A Co, 2/9th Infantry, USAG-Casey, was convicted of Obstruction of Performance of Official Duties.  His adjudged sentence was a 1,000,000 Won fine.

In Uijeongbu District Court on 4 October 2011, 1LT Sabrina A. Gibson, F Co, 302d BSB, USAG- Casey, was convicted of traffic law violations.  Her adjudged sentence was a 1,500,000 Won fine.

In Seoul Central District Court on 4 October 2011, PFC James C. Fox, G Btry, 1/15th FA, USAG-Casey, was convicted of Infliction of Bodily Injury.  His adjudged sentence was a 1,000,000 Won fine.

In Uijeongbu District Court on 5 October 2011, SPC Michael W. Brooks, C Co, 1st BSTB, USAG-Casey, was convicted of Larceny.  His adjudged sentence was a 300,000 Won fine.

In Daegu District Court on 5 October 2011, SGT Carla N. Martin, HHC, 498th CSSB, USAG-Daegu (Carroll), was convicted of Illegal Use of Automobile, Violations of the Road Traffic Law and other crimes.  Her adjudged sentence was imprisonment for 6 months, suspended for 1 year.

In Daegu District Court on 5 October 2011, PFC Jamie F. Mobley, HHC, 501st Sustainment Brigade, USAG-Daegu (Carroll), was convicted of Bodily Injury Resulting from Robbery, Special Robbery, Hit and Run, and other crimes.  His adjudged sentence was imprisonment for 4 years, not suspended.

In Daegu District Court on 5 October 2011, PFC Gabriel D. Dicker, HHC, 501st Sustainment Brigace, USAG-Daegu (Carroll), was convicted of Bodily Injury Resulting from Robbery and Special Robbery.  His adjudged sentence was imprisonment for 3 years and 6 months, not suspended.

In Suwon District Court on 7 October 2011, SSG Carlos Rosado, C Det, JTAGS, Osan Air Base, was convicted of DUI.  His adjudged sentence was a 2,000,000 Won fine.

In Uijeongbu District Court on 7 October 2011, SGT Raul Guardado, Jr., D Btry, 6/37th FA, USAG- Casey, was convicted of Larceny, DUI and Driving Without a License.  His adjudged sentence was a 5,000,000 Won fine.

In Uijeongbu District Court on 17 October 2011, SSG Michael C. Brown, HHC, 1/72d Armor, USAG-Casey, was convicted of DUI.  His adjudged sentence was a 2,000,000 Won fine.

In Uijeongbu District Court on 18 October 2011, SPC Patrick G. Allen, HHC, 1st BSTB, USAG-Casey, was convicted of DUI.. His adjudged sentence was a 1,500,000 Won fine.

In Uijeongbu District Court on 18 October 2011, 2LT Sarecia A. Harris, HHC, 175th FMC, USAG-Yongsan, was convicted of DUI.  Her adjudged sentence was a 2,000,000 Won fine.

In Daegu District Court on 21 October 2011, SPC Adrian L. Mitchell, E Btry, 2-1st ADA, USAG-Daegu (Carroll), was convicted of Destruction and Damage of Property.  His adjudged sentence was a 2,000,000 Won fine.

In Suwon District Court on 21 October 2011, SPC Thomas D. Stout, HHC, USAG-Humphreys, was convicted of Infliction of Bodily Injury.  His adjudged sentence was a 3,000,000 Won fine.

In Seoul Central District Court on 23 October 2011, PFC Michael R. Perry, D Co, 302d BSB, USAG-Casey, was convicted of Larceny and Trespass.  His adjudged sentence was a 300,000 Won.

In Suwon District Court on 25 October 2011, SPC Temika A. Watson, 501st Signal Company, USAG-Humphreys, was convicted of Hit and Run.  Her adjudged sentence was a 2,500,000 Won fine.

In Seoul Central District Court on 26 October 2011, SGT James D. Hardin, B Co, 121st CS Hospital, USAG-Yongsan, was convicted of Infliction of Bodily Injury.  His adjudged sentence was a 2,000,000 Won fine.

In Suwon District Court on 25 October 2011, SGT Scott D. Magee, D Co, 2-2d Aviation, USAG-Yongsan, was convicted of DUI and Hit and Run.  His adjudged sentence was a 10,000,000 Won fine.

In Seoul Central District Court on 25 October 2011, PVT Cody J. Sherman, G Btry, 1/15th FA, USAG- Casey, was convicted of DUI.  His adjudged sentence was a 1,500,000 Won fine.

In Uijeongbu District Court on 28 October 2011, SPC Jerry W. Mattson, B Co, 1/72d Armor, USAG- Casey, was convicted of Bodily Injury Resulting from Robbery.  His adjudged sentence was imprisonment for 3 years, suspended for 4 years.
