Here is an update for those still interested in the much discussed Andre Fisher case:
One year and 19 days after PVT Andre Michael Fisher was arrested by the Korean National Police at 2:20 a.m. on November 19, in front of the Hanggangjin subway station in central Seoul for allegedly committing aggravated robbery against a taxi driver, Fisher’s final appeal to the Supreme Court of Korea was dismissed.
The court delivered the ruling Thursday, December 8 (without even a hearing) stating that the previous adjudications were fairly and sufficiently administered, first, by the Seoul Central District Court 10 June 2011, where Fisher was sentenced to two years, not suspended, and, second, by the Seoul High Court on 25 August 2011, where PVT Fisher’s first appeal was swiftly dismissed. It should be interesting reading that I’m sure will provide much more discussion about this case.

Is this any surprise for Andre Fisher?
1. Based on publicly available information, a great deal of evidence suggests he is guilty.
2. His supporters hid this evidence or directly lied about it.
3. Absolutely NO effort has been made to explain away this evidence.
4. Insultingly-incorrect statements about Korea and arrogant activism on his behalf very likely caused his sentence to be harsh and his appeal to be denied.
…etc.
Further, all serious help offered here, from dealing with the military/Korea… to collecting evidence which would show the truth… to how to make the best of his time in prison, was ignored in favor of more emotional-but-non-specific screeching about vague human rights abuse.
Three Wise Monkeys did a good job investigating ATEK… but they are are looking increasingly unprofessional by grasping at a scandal here that does not exist…
…made worse by constant hints and promises of case-changing evidence that never quite turns up.

Also remember, foreigners in Korea generally find justice in Korean courts, it’s more common than not.
I personally know of several people facing similiar charges that are prime examples.

Fisher’s family lied about the SOFA, they lied about his commanding officer, they lied about…well, just about everything. I’m prone to thinking this “evidence” from T3WM is simply statements from his family. Korean courts may tend to go overboard on occasion against US military defendents (not that I said may); however, I just do not see it in this case.

3WM can’t decide which side it’s on. Initially they were on the whole “Free Fischer” love-in, but then when it became clear that his supports, family and he himself were bold-faced liars, they suddenly pulled stories and deleted content to try and protect their image. Stephanie White should prostrate herself in front of the Ministry of Justice and thank them for not applying the law here to her for her continued and constant accusations against any and all who don’t deign to believe her groundless rants. Do you know why the MoJ hasn’t done anything to her? Becuase, contrary to her rantings, they appear to have compassion for a mother whose young son died.
Why do I mention her again? It’s simple, really. She’s also accusing the US government of refusing to do anything to help her. How many times does she have to be told that the US government will not get involved because, by law, it cannot get involved. Fisher’s case is a bit different, which is something else both Fisher’s family/supporters and White seem unable to grasp. Although the US government is still prohibited from interfering with Fisher’s case, they must, again by law, provide certain assistance to him and also monitor the case, to include ensuring the presence of SOFA observers at all trials. It is ridiculous, even childish, to maintain that (a) the ROK courts would violate the terms of the SOFA agreement in front of SOFA observers and (b) to accuse the US government of failing to act when said government is complying (acting) 100% as required by law.
As mentioned here, on T3WM, and on Dave’s more than a few times by people familiar with Korean law, with US law, and specifically with US military law, Fisher has not been mistreated. His rights were guarded more closely than a Korean suspect’s rights are.
Did you get that last bit, Fisher-supporters? Your hero has been treated better than a Korean suspect by the Korean police, courts, and prison system.
But go ahead and rail against any and all who don’t believe what you wish were true.

Did the authors of the Andre Fisher articles at 3WM even graduate high school?
I would recommend they hire someone with better skills in logic than the Jerry Springer wannabee plot they used for their so-called “investigation.”
They have no legal standing in Korea or anywhere else. They are bloggers, nor recognized members of the Korean Press Corps. They do not understand Korean or American law. They do not understand “chain of custody”. They do not understand the definition of “evidence.” And since they mention several shouting matches with guards and attorneys, they’re acting like arsehats.
All they can do is get Fisher re-sentenced to Life Without Parole at this rate… And maybe that’s their plan…

Comment from “Andre’s Dad” almost floored me, I was laughing so hard. Parents didn’t lie about anything? WRONG! They commenced their lies with the false statement about their little angel and his meeting with his commanding officer.
Once again, for those familiar with (a) South Korea law, (b) United States miltiary law (aka UCMJ), or (c) both (a) and (b), this case is a total fiasco on one side only, that of the defenders. The Korean judicial system seems to have gone to some pretty good extremes to not railroad the accused. And the US government has certainly not abandoned him as the parents and other supporters assert.

#23: Actually, that kind of incident is pretty well unknown in Korean prisons. On top of that (sorry about the awful pun), he’s incarcerated in a private cell.

#22 to be fair, I don’t think it’s a stretch to say the Korean handling of all this left much to be desired, although it’s more a case of lack of motivation in doing a lot of the due diligence than trying to conspire to buil a false accusation against him. I think that was a run-on sentence. Anyway, whatever the way the Korean handling of it was, Andre’s family’s handling of it was actually a greater comedy of errors. There have been calls to the family from several different sites to set the record straight and they never did. Even now they are saying the military didn’t give them any answers and that the info they got was from facebook, skype, etc. Last I checked those are pretty stable media to communicate with. This just shows that Andre was telling them falsehoods from the beginning, none of which the family has backtracked on and even now they are trying to explain away.

Deleted them, huh? It’s almost like…strike that; it’s exactly like what the Fisher family’s been doing on their Facebook page: any post at all that doesn’t echo their line is disappeared. And some people wonder why some of us look at the case askance.
It reminds me so much of what I saw growing up. Some young thug would get arrested and their mother or aunt would say, “But my little boy would never do such a thing. He’s never in trouble. Why, he always give me (insert expensive stuff here). The man’s just picking on him because he doesn’t have a job.” Quick question: if he doesn’t have a job, how does he afford to give you all that expensive stuff?
That’s what we’re dealing with here with the Fisher supporters: refusal to apply logic to his statements and actions.
