USFK Court Martial Results for January 2012

Here are last month’s court martial results that were posted on the USFK website:

At a Special Court Martial on 5 January 2012, SPC Ryan J. Calderon, HHC, 1-72d AR, 1st BCT, APO AP 96224 was found guilty one specification of failure to report and two specifications of AWOL in violation of Article 86, UCMJ; one specification of willfully disobeying the lawful order of a noncommissioned officer, in violation of Article 91, UCMJ; and one specification of violating a lawful general order, one specification of violating a lawful general regulation, and one specification of violating a lawful order, in violation of Article 92, UCMJ.  He was sentenced to 120 days of confinement, reduced to E-1, and to be discharged from the service with a Bad-conduct Discharge.

At a Special Court Martial on 10 January 2012, SSG Samuel W. Comer, B Battery, 1-15th FA, 1st BCT, APO AP 96224 was found guilty of one specifications of assault consummated by a battery, in violation of Article 128, UCMJ; one specification of unlawful entry, in violation of Article 134, UCMJ; and one specification of drunk and disorderly conduct, in violation of Article 121, UCMJ.  He was sentenced to 90 days confinement and reduced to the grade of E-4.

At a Special Court Martial on 11 January 2012, PFC Joseph S. Glavey, C Company, 1BSTB, 1st BCT, APO AP 96224 was found guilty of two specifications of larceny, in violation of Article 121, UCMJ; and one specification of unlawful entry, in violation of Article 134, UCMJ.  He was sentenced to 60 days hard labor without confinement, reduction to E-2, and forfeiture of $800.00 for two months.

At a Special Court Martial on 19 January 2012, PFC Jamal E. Jones, B Company, 302d BSB, 1st BCT, APO AP 96224 was found guilty of two specifications of disrespectful language to a superior noncommissioned officer, in violation of Article 91, UCMJ; one specification of violating a lawful general order (possessing spice), in violation of Article 92, UCMJ; one specification of larceny, in violation of Article 121, UCMJ; and two specifications of assault consummated by a battery, in violation of Article 128, UCMJ.  He was sentenced to 45 days of confinement, and to be discharged from the service with a Bad-conduct Discharge.
Results of ROK Criminal Prosecutions for January 2012

In Seoul Central District Court on 6 January 2012, PVT Davon M. Raeford, 579th Signal Company, USAG-Casey, was convicted of Infliction of Bodily Injury.  His adjudged sentence was Imprisonment for 8 months, not suspended.

In Seoul Central District Court on 9 January 2012, PFC Bryan C. Bryant, 595th Maintenance Company, USAG-Yongsan, was convicted of Larceny, Infliction of Bodily Injury, Violation of the Specialized Credit Financial Business Act and Obstruction of Performance of Official Duties.  His adjudged sentence was a 3,000,000 Won fine.

In Suwon District Court on 9 January 2012, SGT Daniel F. Flores, 303d IS, Osan AB, was convicted of Infliction of Bodily Injury.  His adjudged sentence was a 4,000,000 Won fine.

In Seoul Central District Court on 13 January 2012, PVT Aric A. Smith, HHC, 1/72d Armor, USAG-Casey, was convicted of Violation of the Act on the Control of Narcotics, etc. (Psychotropic Drug).  His adjudged sentence was a Imprisonment for 3 years, suspended for 5 years.

In Seoul Central District Court on 13 January 2012, PVT Johnathan I. Araujo, HHC, 2/9th Infantry, USAG-Casey, was convicted of Violation of the Act on the Control of Narcotics, etc. (Psychotropic Drug).  His adjudged sentence was Imprisonment for 2 years and 6 months, suspended for 3 years.

In Seoul Central District Court on 13 January 2012, PFC Crystal M. Hornedo, HHC, STB-K (S-3), USAG-Yongsan, was convicted of Violation of the Act on the Control of Narcotics, etc. (Psychotropic Drug).  His adjudged sentence was Imprisonment for 2 years and 6 months, suspended for 3 years.

In Seoul Central District Court on 18 January 2012, MSG Brian D. Brown, HHC, 1st Signal Brigade, USAG-Yongsan, was convicted of DUI.  His adjudged sentence was a 1,500,000 Won fine.

In Uijeongbu District Court on 18 January 2012, SGT Christopher J. Coleman, F Co, 302d BSB, USAG-Humphreys, was convicted of traffic law violations.  His adjudged sentence was a 700,000 Won fine.

In Seoul Central District Court on 18 January 2012, SGT Jaime Juarez, HHC, 501st MI Brigade, USAG-Yongsan, was convicted of Violation of the Act on the Punishment of Violences, etc. (Joint Injury).  His adjudged sentence was a 1,500,000 Won fine.

In Seoul Central District Court on 18 January 2012, CPT Douglas Mayes, II, HHC, 1/38th FA, USAG-Casey, was convicted of Violations of the Road Traffic Law (Measures Taken When Accidents Occur) and (Refusal to be Administer the Breath Test).  His adjudged sentence was a 5,000,000 Won fine.

In Suwon District Court on 27 January 2012, SGT Joshua J. Loflin, B Co, 602d ASB, USAG-Humphreys, was convicted of DUI.  His adjudged sentence was a 1,000,000 Won fine.

    What’s with all the HHCs in the ROK Criminal prosecutions? Are those in desk jobs in headquarters companies really committing a high number of crimes, or is it that these troops were reassigned to a HHC from their normal unit after getting into trouble?

    The 9 Jan case of the 595 Maintenance guy – “Violation of the Specialized Credit Financial Business Act”…this one sounds interesting. Anybody have any ideas what this is? Maybe to scan and print some 수표 (Korean checks) again??
