Below are the April 2012 court martial results for everyone to start their week out with by checking out. USFK still has not posted the March 2012 court martial results so I still do not have those to post. I do find it interesting to read the punishments that people have received for crimes that were far less compared to what Colonel James Johnson did. Things of interest this month is the private that received a 108 month confinement sentence for assault and battery. It must have been quite a beating he gave someone to get sentenced that long. Also of interest in a 2nd Lieutenant who received confinement and dismissal for failing to stop an E6 from committing sodomy against a PFC in a public location. Also there was another instance of a soldier being found not guilty of sexual assault. I wonder if the US Court of Appeals for the Armed Forces ruling is influencing these decisions now?

Results of USFK Courts-Martial for April 2012
At a Summary Court-Martial on 3 April 2012, MSG Eric A. Wilkins, Headquarters and Headquarters Company, 1st Signal Brigade, was found guilty of one specification of violating a lawful general order, to wit: USFK Command Policy, General Order Regarding Off-installation Curfew, Article 92, UCMJ, one specification of obstructing justice Article 134, UCMJ, and one specification of drunk and disorderly conduct Article 134, UCMJ, and acquitted of two specifications of making a false official statement, Article 107, UCMJ, and one specification of obstructing justice, Article 134, UCMJ. He was sentenced to reduction to the grade of E-7, forfeiture of $1000 pay, and restriction for 60 days.
At a General Court-Martial on 17 April 2012, PV1 Michael L. Alvarez, A Btry, 1-15FA, 1BCT, 2ID APO AP 96224, was found guilty of disobeying a lawful order, Article 92, UCMJ; arson, Article 126, UCMJ; 2 simple assault, Article 128, UCMJ; 3 assault consummated by battery, Article 128, UCMJ; aggravated assault in which grievous bodily harm is intentionally inflicted; Article 128, UCMJ; drunk and disorderly, Article 134, UCMJ; insubordinate conduct towards a noncommissioned officer, Article 91, UCMJ; aggravated assault with a means likely to produce grievous bodily harm, Article 128, UCMJ. He was sentenced to 108 months of confinement, forfeiture of all pay and allowances and to be discharged from the service with a Bad-conduct Discharge.
At a General Court-Martial on 19 April 2012, 2LT Daniel Mckeller, C CO, 1BSTB, 1BCT, 2ID APO AP 96224, was found guilty of violating a lawful order, Article 92, UCMJ; making a false official statement, Article 107, UCMJ; conduct unbecoming an officer and a gentlemen for wrongfully and dishonorably failing to stop SSG R.G. from committing sodomy with PFC M.N. in a public location and in the presence of PFC B.K., Article 133, UCMJ; conduct unbecoming an officer and a gentlemen for wrongfully and dishonorably, committing sodomy with PFC M.N., in a public location and in the presence of PFC B.K. and SSG R.G., Article 133, UCMJ; two specifications of obstruction of justice, Article 134, UCMJ; and fraternization, Article 134, UCMJ. He was sentenced to 4 months confinement and a dismissal from the service.
At a Summary Court-Martial on 20 April 2012, PFC Anthony D. Cook, 552d Signal Company, 41st Signal Battalion, 1st Signal Brigade, was found guilty of one specification of indecent conduct for engaging in a sexual act in the same room as and in view of others, Article 120, UCMJ, and one specification of conspiracy to commit indecent conduct, Article 81 UCMJ, and acquitted of one specification of assault and battery, Article 128, UCMJ. He was sentenced to forfeiture of $1245 pay.
At a Special Court-Martial on 20 April 2012, PFC Gregory M. Rhodes, B Troop, 4th Squadron, 7th Cavalry, 1st Heavy Brigade Combat Team, 2d Infantry Division, APO AP 96224, was found guilty of failing to report, Article 86, UCMJ; violating a lawful general order by wrongfully possessing a THC substitute, Article 92, UCMJ; conspiracy to violate a lawful general order, Article 81, UCMJ; attempt to violate a lawful general order, Article 80, UCMJ; and wrongfully possessing 12 grams of a schedule I controlled substance, Article 112a. He was sentenced to 90 days of confinement, reduction to the rank of Private (E1), and to be discharged from the service with a Bad-conduct Discharge.
At a Special Court-Martial on 20 April 2012, PFC Gregory M. Rhodes, B Troop, 4/7th Cavalry, 1st BCT, 2d ID, APO AP 96224 was found guilty of one specifications of violating a lawful general order, Article 92, UCMJ; and one specification of AWOL, Article 86, UCMJ. He was sentenced to 90 days confinement, reduction to E-1, and a Bad-conduct Discharge.
At a General Court-Martial on 26 April 2012, SPC Josh D. Hall, C Battery, 2d Battalion, 1st Air Defense Artillery, 35th Air Defense Artillery Brigade, APO AP 96260, was found not guilty of Aggravated Sexual Assault, Article 120, UCMJ and Forcible Sodomy, Article 125, UCMJ.
Results of ROK Criminal Prosecutions for April 2012
In Uijeongbu District Court on 3 April 2012, SPC Kevin M. Gushen, HHB, 6/37th FA, USAG-Casey, was convicted of traffic law violations. His adjudged sentence was a 1,000,000 Won fine.
In Seoul Central District Court on 4 April 2012, PFC Rodney T. Brown, F Co, 3-2d GSAB, USAG-Humphreys, was convicted of Infliction of Bodily Injury. His adjudged sentence was a 1,500,000 Won fine.
In Seoul Central District Court on 5 April 2012, SPC Cory P. Smith, HHC, 1st Signal Brigade, USAG-Yongsan, was convicted of Intrusion of Habitation. His adjudged sentence was a 200,000 Won fine.
In Uijeongbu Court on 5 April 2012, SGT Mark A. Bath, 46th Transportation Company, USAG-Red Cloud (Stanley), was convicted of DUI. His adjudged sentence was a 3,000,000 Won fine.
In Seoul Central District Court on 5 April 2012, SFC Matthew L. Thompson, Tango Security Force, USAG-Yongsan, was convicted of Hit and Run. His adjudged sentence was a 4,000,000 Won fine.
In Suwon District Court on 6 April 2012, MAJ Delvin D. Woolridge-Jones, HHB, 8th Army (I&S Co), USAG-Yongsan, was convicted of Hit and Run. His adjudged sentence was a 5,000,000 Won fine.
In Uijeongbu District Court on 6 April 2012, SPC Marcus R. Lathon, HHC, 1/72d Armor, USAG-Casey, was convicted of use of illegal drugs (Spice). His adjudged sentence was imprisonment for 8 months, suspended for 2 years.
In Seoul Central District Court on 19 April 2012, SPC Diego A. Lopez, E Co, 2-2 Assault, USAG-Yongsan, was convicted of importation of illegal drugs (AM-2201). His adjudged sentence was imprisonment for 2 years and 6 months, suspended for 3 years.
In Seoul Central District Court on 25 April 2012, PVT Rashawn D. Williams, HHD, 25th Transportation Battalion, USAG-Yongsan, was convicted of Joint Infliction of Injury. His adjudged sentence was a 700,000 Won fine.

The lieutenant got sloppy seconds after the SSG – no doubt that’s why he got the sentence that he got. If his only fault was not stopping the SSG from boinking the PFC – he might have been able to survive this.

It’s all in the write up, he also violated a lawful order and made false statements. My guess is fraternization and lying about it.
The two below are why you should never NEVER leave the scene of even the slightest paint trading escapade, even if the Korean driver hit you and said “it’s okay, I’m fine no problem.” Wait for the KNPs and the MPs. It’s not the crime but the coverup or appearance of one.

To add on to what you’re saying about ‘hit and run’, from looking at those fines, they are in the low range of what I’ve seen and been personally privy to with people in my former unit so your advice couldn’t be more on the money (no pun intended…well, maybe just a bit)

You need to look up the definition of sodomy. You do not need to be homosexual to commit sodomy. Unless I am missing something it doesn’t specify the gender of the folks involved. I take it as an LT and SSG mouth or butt banging, and or both a couple female privates in public.

Lemmy has a very good point.
We know SSG R.G. (most likely a male sodomizer) did something to PFC M.N. while PFC B.K. watched. So are BK, RG, and MN guys or dolls?
According to my computer, based on popularity of 1990s baby names and some military statistics on race and social class, B is male (probably Brandon), R could be either male or female but we assume R is a guy (probably Ryan, Rebecca if female with a strapon), and M is likely a girl (Megan or Madison).
My conclusion is that Lemmy has a good idea but it is not backed up by probability.
There is almost a 100% chance that M cried rape regardless of gender.

The Lt participated but there wasn’t enough evidence to convict him of forcible sodomy. I am a female that they assaulted, the judge reduced the Ssg in rank to E1 and the PFC received discharge in Lou of a court martial. To me it seemed that the judge was spineless in his sentencing.
