USFK Court Martial Results for August 2012

It has been some time since USFK posted some new court martial results but below are the latest ones from August 2012.  As usual most of the off post crime involves driving:

Results of Eighth Army Court-Martial Convictions for August 2012

At a Special Court-Martial (Guilty Plea) on 10 August 2012, PVT Tod O. Souriyachack, HHC, USAG-Daegu, was found guilty of one specification of wrongful appropriation, in violation of Article 121, UCMJ; one specification of damage to military property, in violation of Article 108, UCMJ; and one specification of housebreaking, in violation of Article 130, UCMJ.  He was sentenced to 3 months confinement, forfeiture of $994 per month for three months, and a bad-conduct discharge.

At a Summary Court-Martial on 17 August 2012, SPC Jeffery A. CRAGO, Jr., Headquarters and Headquarters Company, 2nd Battalion, 1st Air Defense Artillery, 35th Air Defense Artillery, Camp Carroll, Korea, APO AP  96260, was found guilty of one (1) specification of simple assault, two (2) specifications of assault consummated by a battery, and one (1) specification of aggravated assault, in violation of Article 128, UCMJ.  He was sentenced to 20 days of confinement, reduction to the grade of E-3, and forfeiture of 2/3 pay for one (1) month.

Results of ROK Criminal Prosecutions for August 2012

In Uijeongbu District Court on 3 August 2012, SSG Justin R. Haney, B Co, 2/9th Infantry, USAG-Casey, was convicted of traffic law violations.  His adjudged sentence was a 2,000,000 Won fine.

In Uijeongbu District Court on 7 August 2012, CPT Victor A. Kareh, A Co, 4-2d Aviation, USAG-Humphreys, was convicted of traffic law violations.  His adjudged sentence was a 1,500,000 Won fine.

In Uijeongbu District Court on 24 August 2012, SPC Joshua T. Abshier, B Btry, 6/52d ADM, USAG-Casey, was convicted of violations of the Narcotics Control Law (Psychotropic Drug).  His adjudged sentence was imprisonment for 2 years and 6 months, suspended for 3 years.

In Uijeongbu District Court on 29 August 2012, SPC Robert J. Scherer, D FSC, 6/37th FA, USAG-Casey, was convicted of Larceny, Misappropriation of Official Emblems and Violation of the Motor Vehicles Management Act.  His adjudged sentence was imprisonment for 1 year, suspended for 2 years.

In Uijeongbu District Court on 29 August 2012, PVT Aaron A. Flores, D FSC, 6/37th FA, USAG-Casey, was convicted of Larceny, Misappropriation of Official Emblems and Violation of the Motor Vehicles Management Act.  His adjudged sentence was imprisonment for 1 year, suspended for 2 years.

    At a Summary Court-Martial on 07 September 2012, SFC Samuel V. Pearson, Jr., Headquarters Support Company, Headquarters and Headquarters Battalion, Eighth Army, APO AP 96205, was found guilty of one specification of absent without leave, in violation of Article 86, UCMJ; two specifications of failure to obey a lawful order, in violation of Article 90, UCMJ, three specifications of violating a lawful general order, in violation of Article 92, UCMJ; and one specification of wrongful appropriation of a non-tactical vehicle, in violation of Article 121, UCMJ. He was found not guilty of two specifications of violation of a lawful general order, Article 92, UCMJ; one specification of drunken driving, Article 111, UCMJ; one specification of drunk on duty, Article 112, UCMJ; and one specification of larceny of unit informal funds, Article 121 UCMJ. He was sentenced to reduction to the grade of E6, forfeiture of $2,360 for one (1) month, and to be restricted to the limits of the company area, dining/medical facility, place of worship, and place of duty for two months.

    At a General Court-Martial on 10 September 2012, CW2 Dae Y. Kim, A Co, 719th MP Bn, 501st MI Bde, APO AP 96271, was found not guilty of one specification of assault consummated by a battery, not guilty of one specification of assault upon a warrant officer, not guilty of one specification of assault, aggravated-inflicting grievous bodily harm, not guilty of one specification of assault, aggravated-with a dangerous weapon, means, or force, in violation of Article 128, UCMJ.

    At a Special Court-Martial empowered to adjudge a Bad-Conduct Discharge on 24 September 2012, PFC Justin R. King, B Battery, 1st Battalion, 38th Field Artillery, 210th Fires Brigade, was found guilty of one specification of dereliction of duty, in violation of Article 92, UCMJ; seven specifications of larceny, in violation of Article 121, UCMJ; and seven specifications of stealing mail, in violation of Article 134, UCMJ. He was sentenced to reduction to E-1, 12 months confinement, forfeiture of $994 per month for 12 months, and a Bad-Conduct Discharge.

    At a Summary Court-Martial on 28 September 2012, SFC Courtney C. Crawford, HHC, 194th CSSB, 501st SBDE, APO AP 96271, was found guilty of one specification of failing to obey a lawful general order, in violation of Article 92, UCMJ; one specification of damage to military property, in violation of Article 108, UCMJ; and one specification of driving under the influence of alcohol, in violation of Article 111, UCMJ. He was sentenced to reduction to the grade of E-6, and restriction for two months.

    At a Summary Court-Martial on 28 September 2012, SPC Gabriel A. Gilmeneses, D Co, 1BSTB, 1ABCT, 2ID, was found guilty of one specification of disrespect towards a superior noncommissioned officer, in violation of Article 91, UCMJ; and he was found not guilty of two specifications of assault consummated by battery, in violation of Article 128, UCMJ. He was sentenced to forfeiture of $1320 pay for one month, reduction to the grade of E-3, restriction for 45 days, and extra duty for 45 days.
