Details from Sinclair Case Come Out As Court Martial Nears

The Washington Post has an update about the details coming out from the General Sinclair case:

Brig. Gen. Jeffrey A. Sinclair, an Army Ranger and paratrooper, stands accused of forcible sodomy, adultery and other charges that could land him in prison. Prosecutors say he abused his command authority by sleeping with a subordinate officer, a taboo in the armed forces and a violation of military law.

They charge that the relationship turned violent on two occasions, when he allegedly forced her to perform oral sex.

In addition, Sinclair faces charges that he had inappropriate communications with three other female officers.

Sinclair has pleaded not guilty to all charges. Besides the rare spectacle of a general in the dock, however, the case poses a critical test of how the U.S. military handles allegations of sexual assault and misconduct, crimes that have long bedeviled the armed forces. [Washington Post]

Really WP this is a test? So WP if he is found not guilty did the Army fail the test? Is that is what is being implied?

For those that read the whole article I think it will be very hard to convict him of sexual assault because of the evidence that the accuser is a jilted lover. The accuser did not even want him prosecuted for sexual assault and the Army did anyway:

During an evidentiary hearing in November, she said that she still had feelings for Sinclair and that she had not wanted the Army to charge him with forcible sodomy or a violent crime.

“It’s tearing me up, and in a [expletive] way I still love him, and I don’t want him to be upset with me,” she said. “I know it’s very messed up, but there’s a part of me that wants to believe that he really did love me and that I just misinterpreted his actions.”

Defense attorneys have accused her of making up the assault allegations to save her Army career. They said she first told one confidant that the relationship was entirely consensual but gave investigators a different version after she realized that she, too, could be kicked out of the Army for adultery.

Richard L. Scheff, an attorney for Sinclair, noted that the woman has since been granted immunity by the prosecution. “The evidence in this case is paper-thin,” he said. The captain, he said, has “changed her story again and again.”

Considering the lack of evidence there is a good chance he will be found not guilty and if so you can bet the special interests will be claiming he was hooked up by his buddies.

    Glans, there is no doubt that Sinclair committed adultery and abused his position. What is in dispute is whether or not he committed a sexual assault that the evidence presented in this article leaves much doubt of.

    If he was “hooked up by his buddies” this would have never gone to trial, he would have been warned so he could quickly file his retirement packet & the investigation would have been slowed down enough to allow his retirement to occur. Of course the special interests & MSM will never admit this although they know that’s how it works.

    How about this…

    Considering the lack of government funds these days…

    “Under military law, each juror must be senior in rank to the defendant. More than 40 generals were summoned to Fort Bragg from around the world to be interviewed. Most were rejected because they knew Sinclair or other key potential witnesses.”

    So FORTY two-star and above generals, and their entourages, were flown from around the world, and put up at the Motel 6, to be “interviewed”… with the disqualifying questions being ones that could have been easily asked by phone or e-mail.

    I guess it is OK because it comes from a “different budget”, right?

    Modern generals have proven to be pretty ineffective at winning wars but they likely excel at expensive travel for needless interviews… which keeps them feeling important… so, at least, there’s that.

    BTW, after reading more about this case, it is clearly bullshyt.

    He had at least one affair… which is shytty for a normal person but extra shytty for someone in charge of “good order and discipline” and other buzzwords they are quick to force down the throats of others.

    While Leon is correct in principle, that a lot of private things are nobody’s business, exceptional people in exceptional positions with exceptional responsibilities who get exceptional treatment should uphold exceptional standards. A general committing adultery is a liability for many reasons ranging from distraction from the mission to a target of blackmail.

    On the other hand, if you look at the progression of this case and you read some of the whacked-out drama queen e-mails/texts this woman sent, there is little chance of Sinclair being convicted of forcible sodomy unless the jury is scared of the fallout affecting their careers and self-preservation trumps justice… not an impossibility.

    Another way to look at it is this woman is a traitor to America on the scale of Manning and Snowden. She used her youth and sexuality as a tool to damage American military leadership through a program of distraction and additional expense. She brought down a general which removed decades of training and experience from the military. She further engaged in behavior that she well knew would damage the reputation, public opinion, and congressional generosity toward the military if exposed. Maybe Russia will give her asylum.

    Presumably, BG Sinclair has been conducting one-on-one hip pocket training with young female officers for at least the last few years. All I can say is that he must not have been paying close attention to the “whacked out psycho biatch” warnings & indications reports his mind was sending him when he was surveilling this target.
