USFK Court Martial Results for October 2013

Here are the Court Martial and ROK Criminal Prosecution results for October 2013 that were posted on the USFK website.  Not a whole lot happening with USFK court martials with only three cases in October posted.  There was plenty of cases tried in the ROK courts though to include five more DUI convictions.  I think it is going to take more than releasing YouTube videos to fix this problem.

Results of Army Courts-Martial in Korea for October 2013

At a Summary Court-Martial on 09 October 2013, PVT Antwone D. Avery, Headquarters and Headquarters Company, 501st Military Intelligence Brigade, was found guilty of one specification of Violating a Lawful General Order, in violation of Article 92, UCMJ; one specification of Escape from Custody, in violation of Article 95, UCMJ; and two specifications of False Official Statement, in violation of Article 107, UCMJ.  He was sentenced to restriction to the limits of USAG-Yongsan, Republic of Korea, for two months.

At a Summary Court-Martial on 15 October 2013, SPC Aristides Bautista, 55th Military Police Company, 94th Military Police Battalion, 501st Sustainment Brigade, was found guilty of two specifications of wrongfully failing to obey a lawful general order in violation of Article 92, UCMJ.  He was sentenced to confinement for seven (7) days.

At a Summary Court-Martial on 16 October 2013, SFC David J. Allen, Headquarters and Headquarters Company, 19th Expeditionary Sustainment Command, was found guilty of one specification of disorderly conduct, drunkenness in violation of Article 134, UCMJ, and one specification of unlawful entry in violation of Article 134, UCMJ.  He was sentenced to reduction to Staff Sergeant (E-6).

Results of ROK Criminal Prosecutions for October 2013

In Uijeongbu District Court on 8 October 2013, SGT James D. Lea, A Co, HHBN, 2ID, was convicted of DUI.  His adjudged sentence was a 1,500,000 Won fine.

In Suwon District Court on 8 October 2013, SSgt Ernest Rhodes, III, 51st Logistics Readiness Squadron, Osan Air Base, was convicted of violations of the Act on the Control of Narcotics, etc. (Psychotropic Drug).  His adjudged sentence was imprisonment for 2-1/2 years, suspended for 4 years.

In Hongseong Branch of the Daejeon District Court on 15 October 2013, SrA Theron M. Brown, 51st Maintenance Squadron, Osan Air Base, was convicted of DUI.  His adjudged sentence was a 1,500,000 Won fine.

In Hongseong Branch of the Daejeon District Court on 15 October 2013, Amn Clayton S. Quinn, 51st Force Support Squadron, Osan Air Base, was convicted of traffic law violations including DUI and Driving without a License.  His adjudged sentence was a 4,000,000 Won fine.

In Suwon District Court on 17 October 2013, PFC Michael C. Henderson, B Co, 1st BSTB, 1st ABCT, USAG Casey-Hovey, was convicted of a violation of the Act on the Punishment of Acts of Arranging Prostitution, etc.  His adjudged sentence was a 2,000,000 Won fine.

In Suwon District Court on 17 October 2013, 1LT Clayton R. Emrich, HSC, 602d ASB, USAG Humphreys, was convicted of DUI.  His adjudged sentence was a 1,000,000 Won fine.

In Seoul Central District Court on 22 October 2013, SrA Kyle E. Dilling, 51st Security Forces Squadron, Osan Air Base, was convicted of Obstruction of Performance of Official Duties.  His adjudged sentence was a 3,000,000 Won fine.

In Seoul Central District Court on 25 October 2013, SGT Shannon J. Shepard, HHB, 8th Army (S-3), was convicted of Infliction of Bodily Injury.  His adjudged sentence was a 500,000 Won fine.

In Seoul Central District Court on 25 October 2013, SFC James A. Cutts, Sr., HHB, 8th Army (I&S Co), was convicted of DUI.  His adjudged sentence was a 3,000,000 Won fine.

    “was convicted of a violation of the Act on the Punishment of Acts of Arranging Prostitution”

    A GI got busted for some sort of prostitution offense on the local economy and nobody is curious?

    There MUST be an interesting story here… and maybe something to learn.

    Could it been as simple as being observed to solicit a glass door beauty, in the region of the ‘Ville, and been apprehended in the act?

    Or, not being either lazy or a dumbazz, could he have gone somewhere other than the ‘Ville to seek and solicit his salacious target?

    “Act on the Punishment of Acts of Arranging Prostitution” that’s an oddly worded law. Probably has something to do with massage parlors.

    Good guess. A 2005 Supreme Court case denied appeal of massage parlor ‘sexual activity’ not being the same as or nearly sexual intercourse. Therefore we have the aforementioned massage parlor activity being punishable under this law. Must have picked the wrong parlor.

    These days when the military is drawing down big time on personnel and dumping anyone
    that does not behave themselves, are kissing their career goodbye in my opinion. They
    are not going to be visiting the re-up NCO. Morons.
